18         (e)  An eligible county may use funds provided pursuant
19  to s. 212.20(6)(e)7.e. for the following purposes only:
20         1.  Fifteen percent of such funds shall be reserved for
21  use in a brownfield revolving loan program, or for use in a
22  program of microloans or other loans to support small
23  businesses existing in the brownfield area in which the
24  significant new facility is located.
25         2.  Fifteen percent of such funds shall be reserved for
26  a contract between an eligible county and the United Way
27  organization serving such county, under which the United Way
28  organization agrees to administer a program to provide grants
29  to low-performing public schools in the county.
30         a.  To be eligible for a grant under this program, a
31  school must be a public school in the eligible county that has

HOUSE AMENDMENT h1189-05 Bill No. CS/HB 1189 Amendment No. ___ (for drafter's use only) 1 been classified as a "D" or "F" school under standards used by 2 the Department of Education for grading public schools as part 3 of the annual School Accountability Report. 4 b. Grant funds awarded under this subparagraph may be 5 used in any manner deemed by the school principal to be 6 reasonably related to the improvement of the school; however, 7 such grant funds must be used to directly benefit students in 8 kindergarten through third grade at the school receiving the 9 grant. 10 c. The United Way organization shall develop 11 application guidelines and criteria to be used in reviewing 12 applications, with such guidelines and criteria subject to 13 approval by the governing body of the eligible county. Such 14 application guidelines, at a minimum, must require a school 15 applying for funds under this subparagraph to submit a 16 school-improvement plan that explains in detail the proposed 17 use of grant funds and how such use will directly benefit 18 students in kindergarten through third grade. 19 d. No more than 5 percent of the funds reserved under 20 this subparagraph may be used for administrative costs 21 associated with the establishment and operation of this grant 22 program. 23 3. The remainder of such funds shall be used for the 24 public purpose of paying for, or pledging as security for or 25 paying debt service on bonds or other obligations issued to 26 finance, the costs of acquisition, site preparation, 27 infrastructure development, construction, reconstruction, 28 renovation, expansion, or rehabilitation of the qualifying 29 site and significant new facility to be located thereon, or 30 for the costs of infrastructure and other improvements outside 31 the boundaries of the qualifying site but which are necessary 2 File original & 9 copies 04/27/01 hbd0016 09:13 am 01189-0115-533491
HOUSE AMENDMENT h1189-05 Bill No. CS/HB 1189 Amendment No. ___ (for drafter's use only) 1 or helpful to the development or operation of the significant 2 new facility, or for reimbursement of any such costs, and for 3 the costs incurred by it to remediate the qualifying site. The 4 eligible county shall actively accept and solicit 5 African-American and other minority participation in the 6 planning, design, construction, building, maintenance, and 7 operation of the significant new facility. However, if in any 8 fiscal year of the eligible county the funds provided under s. 9 212.20(6)(e)7.e. are in excess of the amount necessary in that 10 fiscal year to pay for the costs related to the bonds for the 11 significant new facility and qualifying site as authorized by 12 this subparagraph and to pay debt service on bonds or other 13 obligations related only to the costs of the bonds for 14 construction of the significant new facility issued to finance 15 all or any part of such costs, such excess funds shall be 16 applied toward or set aside for the redemption of any such 17 bonds and paid to lower the principal of the bonds. 18 19 20 21 22 23 24 25 26 27 28 29 30 31 3 File original & 9 copies 04/27/01 hbd0016 09:13 am 01189-0115-533491
