1 A bill to be entitled
2 An act relating to Pinellas County; amending
3 chapter 75-489, Laws of Florida, as amended;
4 renaming aluminum contractors as specialty
5 structure contractors for construction
6 licensing purposes and revising the scope of
7 work, to conform; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Paragraph (k) of subsection (1) of section
12 11 of chapter 75-489, Laws of Florida, created as paragraph
13 (m) of said subsection by section 1 of chapter 85-490, Laws of
14 Florida, and redesignated as paragraph (k) of said subsection
15 by section 1 of chapter 89-504, Laws of Florida, is amended to
16 read:
17 Section 11. DEFINITIONS.--
18 (1) "Contractor" means, except those herein exempted,
19 any person who, for compensation, undertakes to, or submits a
20 bid to, or does himself or by others, construct, repair,
21 alter, remodel, add to, subtract from, improve any building or
22 structure, including related improvements to real estate for
23 others, or for resale to others and who is responsible for
24 substantially the entire project. A contractor shall
25 subcontract the electrical, mechanical, plumbing, sheet metal,
26 roofing, commercial swimming pool, and air conditioning work
27 if an examination for a certificate of competency or a license
28 is required for such work, unless the contractor holds a
29 certificate of competency or license in such classification.
30 The term "contractor" includes the following:

1 (k)1. "Specialty Structure Contractor" is a contractor
2 whose services are limited to the execution of contracts
3 requiring the experience, knowledge, and skill necessary for
4 fabrication, assembling, handling, erection, installation,
5 dismantling, adjustment, alteration, repair, servicing, and
6 design work when not prohibited by law, in accordance with
7 accepted engineering data, the manufacturer's specifications,
8 or both, in aluminum, metal, canvas, vinyl, and fiberglass
9 screening and allied construction materials.
10 2. The scope of such work shall:
11 a. Include and be limited to fabric coverings on metal
12 substructures, screened porches, screened enclosures, pool
13 enclosures, preformed panel-post and beam roofs, mobile home
14 panel roofovers, residential glass window and door enclosures,
15 vinyl panel window enclosures, guardrails and handrails,
16 window and door opening protectives, single-story
17 self-contained aluminum utility storage structures (not to
18 exceed 500 square feet), siding, soffit, fascia, and gutters.
19 b. Include woodwork incidental to the aluminium and
20 allied materials construction work and be limited to the
21 construction of wood framing for the walls of uninhabitable
22 utility storage structures and raised wood decks for
23 enclosures and the repair or replacement of wood incidental to
24 the installation of glass windows and doors, siding, soffit,
25 fascia, gutters, and preformed panel-post and beam roofs.
26 c. Include masonry concrete work and be limited to
27 foundations, slabs, and block kneewalls incidental to the
28 aluminum and allied construction materials construction work.
29 d. Comply with all plans, specifications, codes, laws,
30 and regulations applicable.

1 3. The specialty structure contractor, whose services
2 are limited, shall not perform any work that alters the
3 structural integrity of the building, including, but not
4 limited to, roof trusses, lintels, load-bearing walls, and
5 foundations.
6 4. The specialty structure contractor shall
7 subcontract, with a licensed qualified contractor in the field
8 concerned, all other work incidental to that which is defined
9 herein but which is the work of a trade other than that of a
10 specialty structure contractor. Nothing in this definition
11 shall be construed to limit or infringe upon the scope of work
12 of any specialty contractor certified pursuant to sections
13 489.105(3) and 489.113(6), Florida Statutes.
14 (k) "Aluminum Contractor" means any person whose
15 services are unlimited in the aluminum construction trade and
16 who has the experience, knowledge and skill necessary for the
17 manufacture, fabrication, assembling, handling, erection,
18 installation, dismantling, adjustment, alteration, repair,
19 servicing, and design when not prohibited by law, of aluminum
20 metal work. The scope of such work shall include, but not be
21 limited to, screen porches, screen enclosures, siding, soffit
22 and fascia, self-contained aluminum structures, and any other
23 types of construction consisting primarily of aluminum and
24 such masonry concrete which is incidental to the aluminum
25 work.
26 Section 2. This act shall take effect upon becoming a
27 law.
