  1                      A bill to be entitled

  2         An act relating to sentencing; amending s.

  3         921.0022, F.S.; authorizing a judge to sentence

  4         a defendant regardless of the sentence score

  5         computed under the Criminal Punishment Code if

  6         the state and the defendant waive computation

  7         of the sentence score; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (1) of section 921.0022, Florida

13  Statutes, is amended to read:

14         921.0022  Criminal Punishment Code; offense severity

15  ranking chart.--

16         (1)  The offense severity ranking chart must be used

17  with the Criminal Punishment Code worksheet to compute a

18  sentence score for each felony offender whose offense was

19  committed on or after October 1, 1998. However, if the state

20  and the defendant waive the preparation of a Criminal

21  Punishment Code worksheet and computation of the defendant's

22  sentence score, the judge may impose a sentence regardless of

23  the sentence score.

24         Section 2.  This act shall take effect July 1, 2001.

28    Provides that a judge may impose sentence regardless of
      the defendant's sentence score computed under the
29    Criminal Punishment Code if the state and the defendant
      waive computation of the sentence score.
