11  Senator Holzendorf moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 133, line 31, after the period
15  
16  insert:  
17         Section 66.  The Agency for Health Care Administration
18  shall require that a portion of each nursing facility's
19  Medicaid rate increase be used exclusively for wage and
20  benefit increases for nursing home direct care staff. Such
21  funds shall be used only for actual wage or benefit
22  improvements. Eligible staff members include all direct care
23  workers (including RNs, LPNs and CNAs), and all dietary,
24  housekeeping, laundry, and maintenance workers. Temporary,
25  contract, agency, and pool employees are excluded. The agency
26  shall develop cost-reporting systems to ensure that the funds
27  the agency has required to be used for wage and benefit
28  increases for direct care staff are used for this purpose. On
29  January 1 of each year, the agency shall report to the
30  Legislature the effect of such wage and benefit increases for
31  employees in nursing facilities in this state.
