17 and insert:
18 Section 3. The Agency for Health Care Administration
19 and the Office of the Attorney General shall jointly study the
20 potential use of electronic monitoring devices in nursing home
21 facilities licensed under part II of chapter 400, Florida
22 Statutes. The study shall include, but not be limited to, a
23 review of the current use of electronic monitoring devices by
24 nursing home facilities and their residents and other health
25 care facilities, an analysis of other state laws and proposed
26 legislation related to the mandated use of electronic
27 monitoring devices in nursing home facilities, an analysis of
28 the potential ramifications of requiring facilities to install
29 such devices when requested by or on behalf of a resident, the
30 impact of the devices on the privacy and dignity of both the
31 resident on whose behalf the device is installed and other

1 residents who may be affected by the device, the potential
2 impact on improving the care of residents, the potential
3 impact on the care environment and on staff recruitment and
4 retention, appropriate uses of any tapes if mandated by law,
5 including methods and time frames for reporting any
6 questionable incidents to the facility and appropriate
7 regulatory agencies, appropriate security needed to protect
8 the integrity of tapes for both the protection of the resident
9 and direct care staff, and the potential ramifications on the
10 care environment of allowing the use of recorded tapes in
11 legal proceedings, including any exceptions that should apply
12 if prohibited. The Agency for Health Care Administration shall
13 have the lead on the study and shall submit the findings and
14 recommendations of the study to the Governor, the Speaker of
15 the House of Representatives and the President of the Senate
16 by January 1, 2002.
