17  and insert:  
18         (c)  The employer either by action or omission of its
19  principal, managerial employee, corporation or other legal
20  entity knowingly permitted a dangerously unsafe condition to
21  exist that presented a high likelihood of injury or death that
22  contributed to the loss, damages, or injury suffered by the
23  resident.
