11  Senators Pruitt and Dyer moved the following amendment:

13         Senate Amendment 
14         On page 32, lines 2-7, and
15         On page 108, lines 12-17, delete those lines
16  
17  and insert:  of the defendant, punitive damages may be awarded
18  to punish the defendant and deter such conduct. There shall be
19  no cap on punitive damages awarded under this paragraph;
20  however, the finder of fact shall be instructed that any
21  punitive damage award shall not bankrupt a defendant or create
22  unreasonable financial hardship. In making this determination,
23  the fact finder shall consider the following:
24         1.  The nature, extent, and degree of misconduct by the
25  defendant;
26         2.  The defendant's financial resources, including net
27  worth, revenues, expenses, and any other relevant financial
28  information; and
29         3.  Any other circumstances and mitigating factors that
30  may affect the amount of punitive damages, including the
31  assessment of punitive damages against the defendant in any
