13         Amendment to Amendment (341895) 
14         On page 40, line 25, after the period
15  
16  insert:  A nursing facility that has failed to comply with
17  state minimum staffing requirements for two consecutive days
18  shall be prohibited from accepting new admissions until such
19  time as the facility has achieved the minimum staffing
20  requirements for a period of 6 consecutive days. For purposes
21  of this subparagraph, any person who was a resident of the
22  facility and was absent from the facility for the purpose of
23  receiving medical care at a separate location or was on a
24  leave of absence shall not be considered a new admission.
25  Failure to impose such an admissions moratorium constitutes a
26  class II deficiency.
