18  balance. However, for any full-time employee of the district
19  school board other than instructional staff or an educational
20  support employee as defined in this section, in lieu of such
21  authorized cash payment, that same amount may be contributed
22  annually by the employer, upon request by the employee, to an
23  approved pretax retirement account in the name of the
24  employee, pursuant to rules of the school board and in
25  compliance with federal tax laws and regulations. Such annual
26  payment may apply only to instructional
