1 A bill to be entitled
2 An act relating to pharmaceutical expense
3 assistance; amending s. 409.9065, F.S.;
4 increasing the maximum income level for
5 eligibility under the pharmaceutical expense
6 assistance program; increasing the maximum
7 monthly benefit amount per participant;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraph (b) of subsection (2) and
13 subsection (3) of section 409.9065, Florida Statutes, are
14 amended to read:
15 409.9065 Pharmaceutical expense assistance.--
16 (2) ELIGIBILITY.--Eligibility for the program is
17 limited to those individuals who qualify for limited
18 assistance under the Florida Medicaid program as a result of
19 being dually eligible for both Medicare and Medicaid, but
20 whose limited assistance or Medicare coverage does not include
21 any pharmacy benefit. Specifically eligible are low-income
22 senior citizens who:
23 (b) Have an income between 90 and 150 120 percent of
24 the federal poverty level;
25 (3) BENEFITS.--Medications covered under the
26 pharmaceutical expense assistance program are those covered
27 under the Medicaid program in s. 409.906(20). Monthly benefit
28 payments shall be limited to $150 $80 per program participant.
29 Participants are required to make a 10-percent coinsurance
30 payment for each prescription purchased through this program.
31 Section 2. This act shall take effect July 1, 2001.
