18 Section 44. The sum of $1,000,000 is appropriated from
19 nonrecurring General Revenue funds for Fiscal Year 2001-2002,
20 to the Executive Office of the Governor, Office of Tourism,
21 Trade and Economic Development to contract with Enterprise
22 Florida, Inc., to promote the growth of employment in the
23 Information Technology Industry and expended as follows:
24 There shall be paid an incentive payment to a qualifying
25 corporation in an amount equal to the product of$3,000 and the
26 total number of full-time Florida employees in the employ of
27 the qualifying corporation as of December 31, 2001. Incentive
28 payments shall be made to qualifying corporations submitting
29 applications after February 15, 2002 until $1,000,000
30 appropriated for this purpose is depleted, in the order in
31 which applications from qualifying corporations are received

1 by Enterprise Florida, Inc. The amount of the incentive
2 payment made to an individual corporation cannot exceed the
3 gross compensation of all new full-time Florida employees
4 hired between January 1, 2001 and December 31,2001. For these
5 purposes "qualifying corporation" means an Information
6 Technology Industry corporation (1) whose percentage increase
7 in full-time Florida employees equals or exceeds ten percent
8 or whose new full-time Florida employees is at least 50 and
9 (2) the average gross compensation of all its full-time
10 Florida employees for calendar year 2001 exceeds $60,000. A
11 corporation is an "Information Technology Industry"
12 corporation if it derives more than 50% of its revenues during
13 calendar year 2001 from (1) designing, developing,
14 manufacturing, processing, or producing computer software,
15 including but not limited to operating systems, software
16 applications, internet enablement software, business
17 information systems software, and enterprise resource planning
18 software, or (2) the sale to end users of voice or data
19 services delivered over a broadband facility capable of
20 transmission in speeds in excess of 128kbps. "New full-time
21 Florida employees" means the number of full-time Florida
22 employees as of December 31, 2001 less the number of full-time
23 Florida employees as of December 31, 2000. "Full-time Florida
24 employee" means an employee who performs duties for an average
25 of 36 hours or more per week and is reported on the
26 corporation's Florida Unemployment Compensation Report, Form
27 UCT-6. "New employee" means an employee hired or relocated to
28 Florida on or after January 1, 2001 and during calendar year
29 2001. An individual employed in Florida by a member of the
30 same affiliated group of corporations at any time during the
31 12 months preceding the date of hire or relocation by the

1 qualifying corporation shall not be counted as a new employee.
2 "Gross compensation" means all amounts reported in Box 5 of
3 the employee's Federal Form W-2, Wages and Tax Statement.
4 Average gross compensation shall mean total gross compensation
5 for all full-time Florida employees for calendar year 2001
6 divided by the number of full-time Florida employees as of
7 December 31, 2001. A qualifying corporation shall include
8 with its application for incentive payments documentation
9 reflecting compliance with the foregoing job growth and
10 compensation requirements. Such documentation may include W-2
11 forms, state unemployment compensation tax returns or other
12 supporting schedules. The funds subject to this proviso shall
13 be subject to the provisions of s. 216.301(1)(a).
