4 additional members of the board of directors of
5 Workforce Florida, Inc.; specifying selection
6 of such members by certain members of regional
7 workforce development boards; amending s.
8 445.007, F.S.; specifying certain additional
9 members of regional workforce development
10 boards; specifying certain local organizations
11 to be involved in selecting such members;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Paragraph (a) of subsection (3) of section
17 445.004, Florida Statutes, is amended to read:
18 445.004 Workforce Florida, Inc.; creation; purpose;
19 membership; duties and powers.--
20 (3)(a) Workforce Florida, Inc., shall be governed by a
21 board of directors, the number of directors to be determined
22 by the Governor, whose membership and appointment must be
23 consistent with Pub. L. No. 105-220, Title I, s. 111(b), and
24 contain one member representing the licensed nonpublic
25 postsecondary educational institutions authorized as
26 individual training account providers, one member from the
27 staffing service industry, three members who are persons
28 eligible to participate in the Temporary Assistance for Needy
29 Families Program, and five representatives of organized labor
30 who shall be appointed by the Governor. Members of the board
31 who are eligible to participate in the Temporary Assistance

1 for Needy Families Program shall be selected by the combined
2 members of the regional workforce boards who are eligible to
3 participate in the Temporary Assistance for Needy Families
4 Program, as provided in s. 445.007. Notwithstanding s.
5 114.05(1)(f), the Governor may appoint remaining members to
6 Workforce Florida, Inc., from the current Workforce
7 Development Board and the WAGES Program State Board of
8 Directors, established pursuant to chapter 96-175, Laws of
9 Florida, to serve on the reconstituted board. By July 1, 2000,
10 the Workforce Development Board will provide to the Governor a
11 transition plan to incorporate the changes required by this
12 act and Pub. L. No. 105-220, specifying the manner of changes
13 to the board. This plan shall govern the transition, unless
14 otherwise notified by the Governor. The importance of
15 minority, gender, and geographic representation shall be
16 considered when making appointments to the board.
17 Section 2. Subsection (1) of section 445.007, Florida
18 Statutes, is amended to read:
19 445.007 Regional workforce boards.--
20 (1) One regional workforce board shall be appointed in
21 each designated service delivery area and shall serve as the
22 local workforce investment board pursuant to Pub. L. No.
23 105-220. The membership of the board shall be consistent with
24 Pub. L. No. 105-220, Title I, s. 117(b), and contain one
25 representative from a nonpublic postsecondary educational
26 institution that is an authorized individual training account
27 provider within the region and confers certificates and
28 diplomas, one representative from a nonpublic postsecondary
29 educational institution that is an authorized individual
30 training account provider within the region and confers
31 degrees, three members who are persons eligible to participate

1 in the Temporary Assistance for Needy Families Program, and
2 three representatives of organized labor. Local nonprofit,
3 public service, community-based organizations in each region
4 shall be involved in the selections of the three members of
5 the board in the region who are eligible to participate in the
6 Temporary Assistance for Needy Families Program. The three
7 members of each regional workforce board who are eligible to
8 participate in the Temporary Assistance for Needy Families
9 Program shall be involved in the selection of the three
10 members of the board of directors of Workforce Florida, Inc.,
11 who are eligible to participate in the Temporary Assistance
12 for Needy Families Program, as required in s. 445.004.
13 Individuals serving as members of regional workforce
14 development boards or local WAGES coalitions, as of June 30,
15 2000, are eligible for appointment to regional workforce
16 boards, pursuant to this section. The importance of minority
17 and gender representation shall be considered when making
18 appointments to the board. If the regional workforce board
19 enters into a contract with an organization or individual
20 represented on the board of directors, the contract must be
21 approved by a two-thirds vote of the entire board, and the
22 board member who could benefit financially from the
23 transaction must abstain from voting on the contract. A board
24 member must disclose any such conflict in a manner that is
25 consistent with the procedures outlined in s. 112.3143.
26 Section 3. This act shall take effect upon becoming a
27 law.

Requires that three members of the board of directors of
4 Workforce Florida, Inc., be persons eligible to
participate in the Temporary Assistance for Needy
5 Families Program, that such persons be selected by
similar persons who are members of regional workforce
6 development boards, and that local nonprofit, public
service, community-based organizations be involved in
7 selecting such members of the regional boards.
