  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Citrus Canker Compensation Trust Fund within

  4         the Department of Agriculture and Consumer

  5         Services; providing for sources of money and

  6         purposes; providing for annual carryforward of

  7         funds; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing a contingent effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Citrus Canker Compensation Trust Fund

14  created; limited purposes.--

15         (1)  There is created the Citrus Canker Compensation

16  Trust Fund within the Department of Agriculture and Consumer

17  Services. The proceeds of the excise tax on standard packed

18  boxes of citrus fruit shall be credited to the trust fund, as

19  well as any moneys specifically transferred or appropriated

20  for transfer to the fund in the General Appropriations Act.

21         (2)  The Citrus Canker Compensation Trust Fund shall be

22  administered by the Department of Agriculture and Consumer

23  Services and shall be used for the purposes of paying

24  compensation to claimants for citrus trees destroyed pursuant

25  to the state's eradication of citrus canker, for administering

26  the compensation program, or as otherwise provided for in the

27  General Appropriations Act.

28         (3)  Notwithstanding section 216.301, Florida Statutes,

29  and pursuant to section 216.351, Florida Statutes, any balance

30  in the trust fund at the end of any fiscal year shall remain

  1  in the trust fund at the end of the year and shall be

  2  available for carrying out the purposes of the trust fund.

  3         (4)  Pursuant to Section 19(f)(2), Article III of the

  4  State Constitution, the trust fund shall, unless terminated

  5  sooner, be terminated on July 1, 2005. However, before its

  6  scheduled termination, the trust fund shall be reviewed as

  7  provided in section 215.3206(1) and (2), Florida Statutes.

  8         Section 2.  This act shall take effect upon becoming a

  9  law, but it shall not take effect unless it is enacted by at

10  least a three-fifths vote of the membership of each house of

11  the Legislature.
