  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Citrus Canker Compensation Trust Fund within

  4         the Department of Agriculture and Consumer

  5         Services; providing for sources of money and

  6         purposes; providing for annual carryforward of

  7         funds; providing for future review and

  8         termination or re-creation of the trust fund;

  9         providing a contingent effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Citrus Canker Compensation Trust Fund

14  created; limited purposes.--

15         (1)  There is created the Citrus Canker Compensation

16  Trust Fund within the Department of Agriculture and Consumer

17  Services. Funds to be credited to the trust fund shall consist

18  of moneys specifically transferred or appropriated for

19  transfer to the trust fund in the General Appropriations Act.

20         (2)  The Citrus Canker Compensation Trust Fund shall be

21  administered by the Department of Agriculture and Consumer

22  Services and shall be used for the purposes of paying

23  compensation to claimants for citrus trees destroyed on

24  residential property pursuant to the state's eradication of

25  citrus canker, for administering the compensation program, or

26  as otherwise provided for in the General Appropriations Act.

27         (3)  Notwithstanding section 216.301, Florida Statutes,

28  and pursuant to section 216.351, Florida Statutes, any balance

29  in the trust fund at the end of any fiscal year shall remain

30  in the trust fund at the end of the year and shall be

31  available for carrying out the purposes of the trust fund.

  1         (4)  Pursuant to Section 19(f)(2), Article III of the

  2  State Constitution, the trust fund shall, unless terminated

  3  sooner, be terminated on July 1, 2005. However, before its

  4  scheduled termination, the trust fund shall be reviewed as

  5  provided in section 215.3206(1) and (2), Florida Statutes.

  6         Section 2.  This act shall take effect on the date that

  7  Senate Bill 170, relating to citrus canker compensation, or

  8  similar legislation takes effect, but it shall not take effect

  9  unless it is enacted by at least a three-fifths vote of the

10  membership of each house of the Legislature.

12          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
13                         Senate Bill 1244

15  Committee Substitute for Senate Bill 1244 is different from
    Senate Bill 1244 in that it:
16
          --Specifies that funds credited to the Citrus Canker
17        Compensation Trust Fund shall consist of moneys
          specifically transferred or appropriated for transfer in
18        the General Appropriations Act.

19        --Clarifies that compensation will be paid to claimants
          for citrus trees destroyed on residential property.

          --Provides that the act shall take effect on the date
21        Senate Bill 170, relating to citrus canker compensation,
          or similar legislation takes effects.
