2 An act relating to state reserves; creating s.
3 258.166, F.S.; establishing the North Florida
4 State Reserve; directing the Division of
5 Recreation and Parks of the Department of
6 Environmental Protection to develop
7 multipurpose recreational opportunities and
8 provide supervision of the area; allowing
9 public hunting; authorizing the Division of
10 State Lands to acquire adjacent or contiguous
11 property; requiring the Division of State Lands
12 to notify persons with easements in the area;
13 requiring a report; authorizing and directing
14 the construction of certain facilities, subject
15 to appropriations; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Section 258.166, Florida Statutes, is
20 created to read:
21 258.166 North Florida State Reserve designated.--There
22 is designated and established a state reserve to be known as
23 North Florida State Reserve, in Marion and Putnam counties,
24 which shall include all state-owned lands within the
25 floodplain of the Oklawaha River and those hereafter acquired
26 by the state from Eureka Dam in Marion County to Buckman Lock
27 in Putnam County. Those lands are deemed and held to be a
28 state reserve, under the supervision of the Division of
29 Recreation and Parks of the Department of Environmental
30 Protection. The division is charged with the duty of providing
31 for the development of multipurpose recreational opportunities

1 at this reserve and the care, upkeep, maintenance, and
2 beautification of the North Florida State Reserve including
3 all those dams, locks, and other structures transferred by the
4 federal government to the state.
5 (1) Public hunting is allowed in the state reserve as
6 authorized by the Fish and Wildlife Conservation Commission.
7 (2) The Division of State Lands of the Department of
8 Environmental Protection may acquire in the name of the Board
9 of Trustees of the Internal Improvement Trust Fund any
10 additional property adjacent or contiguous to the North
11 Florida State Reserve, from private owners or from the United
12 States Government for improved management and recreational
13 opportunities.
14 (3) The Division of State Lands shall identify,
15 contact, and inform all property owners who entered into
16 easements located within the taking line of the Rodman
17 Reservoir of the designation of this area as a state reserve.
18 (4) By January 1, 2002, the Division of State Lands
19 shall submit a report to the Executive Office of the Governor,
20 the President of the Senate, and the Speaker of the House of
21 Representatives which:
22 (a) Identifies the entities that have an easement
23 within the taking line of the reservoir.
24 (b) Indicates whether the holder of the easement is
25 willing to sell the easement.
26 (c) Estimates the cost of acquiring the easements.
27 (d) Identifies any additional issues resulting from
28 this designation.
29 Section 2. Subject to appropriations, the Department
30 of Environmental Protection is authorized and directed to
31 construct restroom facilities, a paved parking lot, small

1 spectator bleachers, boat ramps, and a covered pavilion by
2 that part of Rodman Reservoir which is considered to be the
3 old Oklawaha River bed. Funds provided in the General
4 Appropriations Act for fiscal year 2001-2002 shall be used for
5 construction as directed in this section regardless of whether
6 the George Kirkpatrick Dam remains in place, and moneys so
7 appropriated may be used only for the purposes expressed in
8 this section. Furthermore, funds made available in the General
9 Appropriations Act for fiscal year 2001-2002 for sediment
10 management and studies at the George Kirkpatrick Dam may be
11 expended only for such purposes if funds made available in the
12 General Appropriations Act for fiscal year 2001-2002 for the
13 construction activities authorized in this section are also
14 expended.
15 Section 3. This act shall take effect upon becoming a
16 law.

18 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
19 Senate Bill 1246

21 The CS changes the name of the Reserve to the North Florida
State Reserve and deletes provisions prohibiting any action
22 that would substantially alter the Reserve as it existed on
January 1, 2000 unless approved by law.

The CS also provides that, subject to appropriations, the DEP
24 is authorized and directed to construct restroom facilities, a
paved parking lot, small spectator bleachers, boat ramps, and
25 a covered pavilion by that part of Rodman Reservoir which is
considered to be the old Oklawaha River bed. Funds provided in
26 the General Appropriations Act for FY 2001-2002 shall be used
for construction as directed in section 2 of the CS regardless
27 of whether the George Kirkpatrick Dam remains in place, and
moneys so appropriated may be used only for the purposes
28 expressed in section 2. Furthermore, funds made available in
the General Appropriations Act for FY 2001-2002 for sediment
29 management and studies at the George Kirkpatrick Dam may only
be expended for such purposes if funds made available in the
30 General Appropriations Act for FY 2001-2002 for the
construction activities authorized in section 2 are also
31 expended.
