13         Amendment to Amendment (254301) (with title amendment) 
14         On page 25, between lines 17 and 18,

16  insert:  
17         Section 1.  Effective upon this act becoming a law,
18  section 553.84, Florida Statutes, is amended to read:
19         553.84  Statutory civil action.--Notwithstanding any
20  other remedies available, any person or party, in an
21  individual capacity or on behalf of a class of persons or
22  parties, damaged as a result of a violation of this part or
23  the State Minimum Building Codes, has a cause of action in any
24  court of competent jurisdiction against the person or party
25  who committed the violation, provided that if the person or
26  party obtains the required building permit and any local
27  government or public agency with authority to enforce the
28  building code approves the plans and the construction project
29  passes all required inspections under the code, and there is
30  no personal injury or damage to property other than the
31  property that is the subject of the permits, plans, and

 1  inspections, this section shall not apply unless the person or
 2  party knew or should have known that the violation existed
 3  notwithstanding the approval of the permits, plans, and
