17 Section 3. Paragraph (b) of subsection (2) of section
18 655.059, Florida Statutes, is amended to read:
19 655.059 Access to books and records; confidentiality;
20 penalty for disclosure.--

22 (b) The books and records pertaining to the deposit
23 accounts and loans of depositors, borrowers, members, and
24 stockholders of any financial institution shall be kept
25 confidential by the financial institution and its directors,
26 officers, and employees and shall not be released except upon
27 express authorization of the account holder as to her or his
28 own accounts, loans, or voting rights. However, information
29 relating to any loan made by a financial institution may be
30 released without the borrower's authorization in a manner
31 prescribed by the board of directors for the purpose of

1 meeting the needs of commerce and for fair and accurate credit
2 information. Information may also be released, without the
3 authorization of a member or depositor but in a manner
4 prescribed by the board of directors, to verify or corroborate
5 the existence or amount of a customer's or member's account
6 when such information is reasonably provided to meet the needs
7 of commerce and to ensure accurate credit information. In
8 addition, a financial institution, affiliate, and its
9 subsidiaries, and any holding company of the financial
10 institution or subsidiary of such holding company, may furnish
11 to one another information relating to their customers or
12 members, subject to the requirement that each corporation
13 receiving information that is confidential maintain the
14 confidentiality of such information and not provide or
15 disclose such information to any unaffiliated person or
16 entity. Notwithstanding this paragraph, nothing in this
17 subsection shall prohibit a financial institution from
18 disclosing financial information as referenced in this
19 subsection as permitted by Public Law 106-102(1999), as set
20 forth in 15 U.S.C.A., s. 6802, as amended.
