1 A bill to be entitled
2 An act relating to state employee travel and
3 per diem; amending s. 112.061, F.S.; increasing
4 the meal allowances for state employees for
5 specified travel; restricting applicability to
6 state agencies operating under an appropriated
7 performance budget; providing for
8 implementation subject to availability of funds
9 and approval by the Executive Office of the
10 Governor; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (6) of section 112.061, Florida
15 Statutes, is amended to read:
16 112.061 Per diem and travel expenses of public
17 officers, employees, and authorized persons.--
18 (6) RATES OF PER DIEM AND SUBSISTENCE ALLOWANCE.--For
19 purposes of reimbursement rates and methods of calculation,
20 per diem and subsistence allowances are divided into the
21 following groups and rates:
22 (a) All travelers shall be allowed for subsistence
23 when traveling to a convention or conference or when traveling
24 within or outside the state in order to conduct bona fide
25 state business, which convention, conference, or business
26 serves a direct and lawful public purpose with relation to the
27 public agency served by the person attending such meeting or
28 conducting such business, either of the following for each day
29 of such travel at the option of the traveler:
30 1. Fifty dollars per diem; or

1 2. If actual expenses exceed $50, the amounts
2 permitted in paragraph (b) for meals, plus actual expenses for
3 lodging at a single-occupancy rate to be substantiated by paid
4 bills therefor.

6 When lodging or meals are provided at a state institution, the
7 traveler shall be reimbursed only for the actual expenses of
8 such lodging or meals, not to exceed the maximum provided for
9 in this subsection.
10 (b) All travelers shall be allowed the following
11 amounts for subsistence while on Class C travel on official
12 business as provided in paragraph (5)(b):
13 1. Breakfast........................................$3
14 2. Lunch............................................$6
15 3. Dinner..........................................$12
16 (c) No one, whether traveling out of state or in
17 state, shall be reimbursed for any meal or lodging included in
18 a convention or conference registration fee paid by the state.
19 A state agency operating under an appropriated
20 performance-based program budget may increase the subsistence
21 amounts by up to an additional 25 percent, subject to the
22 availability of funds and receipt of prior approval from the
23 Executive Office of the Governor.
24 Section 2. This act shall take effect July 1, 2001.
