  1                      A bill to be entitled

  2         An act relating to construction materials

  3         mining activities; repealing s. 552.30, F.S.,

  4         which provides the State Fire Marshal with sole

  5         and exclusive authority to promulgate

  6         standards, limits, and regulations regarding

  7         the use of explosives in conjunction with

  8         construction materials mining activities;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Section 552.30, Florida Statutes, is

14  repealed.

15         Section 2.  This act shall take effect upon becoming a

16  law.

19                          HOUSE SUMMARY

      Repeals s. 552.30, F.S., which:
21         1.  Provides the State Fire Marshal with sole and
      exclusive authority to promulgate standards, limits, and
22    regulations regarding the use of explosives in
      conjunction with construction materials mining
23    activities, defined as the extraction of limestone and
      sand suitable for production of construction aggregates,
24    sand, cement, and road base materials, and specifies the
      scope of such authority.
25         2.  Requires the State Fire Marshal to establish
      statewide ground vibration limits for such activities.
26         3.  Authorizes the State Fire Marshal to delegate to
      applicable municipalities or counties monitoring and
27    enforcement components of such regulation, which may
      include the assessment and collection of fees for
28    carrying out delegated duties.
