1 A bill to be entitled
2 An act relating to public medical assistance;
3 amending s. 409.904, F.S.; providing Medicaid
4 eligibility for women diagnosed with breast or
5 cervical cancer who meet certain criteria;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (9) is added to section 409.904,
11 Florida Statutes, to read:
12 409.904 Optional payments for eligible persons.--The
13 agency may make payments for medical assistance and related
14 services on behalf of the following persons who are determined
15 to be eligible subject to the income, assets, and categorical
16 eligibility tests set forth in federal and state law. Payment
17 on behalf of these Medicaid eligible persons is subject to the
18 availability of moneys and any limitations established by the
19 General Appropriations Act or chapter 216.
20 (9) A woman who has not attained 65 years of age,
21 whose income is at or below 250 percent of the most recently
22 published federal poverty level, and who has been screened for
23 breast or cervical cancer by a qualified entity under the
24 Centers for Disease Control and Prevention breast and cervical
25 cancer early detection program established under Title XV of
26 the Public Health Service Act, in accordance with the
27 requirements of s. 1504 of that act, and needs treatment for
28 breast or cervical cancer and is not otherwise covered under
29 creditable coverage, as defined in s. 2701(c) of the Public
30 Health Service Act. For purposes of this subsection,
31 "qualified entity" includes a county public health department,

1 a community health center, and any community-based service
2 delivery system that provides breast and cervical screening
3 services. In determining the eligibility of such a woman, an
4 assets test is not required. A presumptive eligibility period
5 begins on the date on which a qualified entity determines, on
6 the basis of preliminary information, that all eligibility
7 criteria appear to be met and ends on the date determination
8 is made with respect to the eligibility of such woman for
9 services under the state plan or, in the case of such a woman
10 who does not file an application, by the last day of the month
11 following the month during which the entity makes the
12 presumptive eligibility determination. A woman shall be deemed
13 eligible until she gains creditable coverage, until treatment
14 is no longer necessary, or until attainment of 65 years of
15 age.
16 Section 2. This act shall take effect July 1, 2001.
