11 The Committee on Business Regulation offered the following:

13 Amendment (with title amendment)
14 On page 1, line 17 through page 4, line 12,
15 remove from the bill: all of said lines

17 and insert in lieu thereof:
18 Section 1. Subsection (2) of section 550.0351, Florida
19 Statutes, is amended to read:
20 550.0351 Charity racing days.--
21 (2) The proceeds of charity performances shall be paid
22 to qualified beneficiaries selected by the permitholders from
23 an authorized list of charities on file with the division.
24 Eligible charities include the Racing Scholarship Trust Fund,
25 the Historical Resources Operating Trust Fund, major state and
26 private institutions of higher learning in Florida, Florida
27 community colleges, and any charity that provides evidence of
28 compliance with the provisions of chapter 496 and evidence of
29 possession of a valid exemption from federal taxation issued
30 by the Internal Revenue Service. However, all proceeds
31 donated to a charity under the provisions of this statute must

1 be used to directly fund programs and operations within the
2 state of Florida and may not be used to fund, directly or
3 indirectly, any program or operation outside of the state of
4 Florida. In addition, the authorized list must include the
5 Racing Scholarship Trust Fund, the Historical Resources
6 Operating Trust Fund, major state and private institutions of
7 higher learning, and Florida community colleges.

13 remove from the title of the bill: all of said lines

15 and insert in lieu thereof:
16 An act relating to pari-mutuel wagering;
17 amending s. 550.0351, F.S.; requiring charity
18 day proceeds to be used to fund programs and
19 operations within the state of Florida;
20 providing an effective date.
