17 and insert in lieu thereof: (c)1. Unless extended pursuant
18 to subparagraph 2., this subsection is repealed on June 30,
19 2006.
20 2.a. The governing authority of the municipality may
21 adopt an ordinance calling for a referendum on the extension
22 of the repeal date of the surcharge to June 30, 2045, and an
23 extension of the use of surcharge proceeds. If a majority of
24 the electors of the municipality voting on this question
25 approve such an extension of the repeal date at a regularly
26 scheduled election held by the municipality, this subsection
27 shall be repealed June 30, 2045. If such extension is
28 approved pursuant to this subparagraph, a portion of the
29 proceeds of the surcharge, such portion to be determined by
30 the municipal governing authority, may be used for acquiring
31 land or paying debt service for the construction of a

1 significant new facility, or both.
2 b. As used in this subparagraph, "significant new
3 facility" means a real property improvement on a site located
4 within a brownfield area designated under s. 376.80 that meets
5 the following requirements:
6 (I) It is owned by a county or municipality and leased
7 to, licensed to, or to be operated by a private, for-profit
8 entity for the purpose of operating a business therefrom for a
9 period of not less than 30 years after the date the county or
10 municipality submits the notice required by
11 sub-sub-subparagraph (II).
12 (II) It has an actual cost for construction,
13 reconstruction, renovation, expansion or rehabilitation of the
14 facility of not less than $300 million, of which not less than
15 $50 million, over the term of the lease, license, or operation
16 will be contributed by the private lessee, licensee or
17 operator, which contribution may be in the form of annual
18 payments to be pledged to finance the construction of the
19 facility.
20 (III) It has been proposed, in a report submitted to
21 the county or municipality by a qualified economist, that the
22 facility will have an annual economic impact of not less than
23 $100 million over the term of the lease, license or operation
24 and will create not less than 1,500 jobs over the term.
25 c. A statement that includes a brief general
26 description of the additional uses of the surcharge proceeds
27 authorized pursuant to sub-subparagraph a. shall be placed on
28 the ballot by the municipal governing authority. The following
29 question shall be placed on the ballot:
30 ....FOR the extension of the parking surcharge to June 30,
31 2045.
