2 An act relating to local government; amending
3 s. 218.503, F.S.; revising provisions which
4 authorize certain municipalities which have
5 been declared in a state of financial emergency
6 to impose a per-vehicle surcharge on revenues
7 from the sale or rental of space at parking
8 facilities; revising a requirement relating to
9 such municipality's population; revising the
10 authorized uses of surcharge proceeds; removing
11 the future repeal of such provisions; providing
12 an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (5) of section 218.503, Florida
17 Statutes, is amended to read:
18 218.503 Determination of financial emergency.--
19 (5)(a) The governing authority of any municipality
20 with a resident population of 300,000 or more on April 1,
21 1999, and which has been declared in a state of financial
22 emergency pursuant to this section within the previous 2
23 fiscal years may impose a discretionary per-vehicle surcharge
24 of up to 20 percent on the gross revenues of the sale, lease,
25 or rental of space at parking facilities within the
26 municipality that are open for use to the general public.
27 (b) A municipal governing authority that imposes the
28 surcharge authorized by this subsection may use the proceeds
29 of such surcharge for the following purposes only:
30 1. No less than 60 percent and no more than 80 percent
31 of the surcharge proceeds shall be used by the governing

1 authority to facilitate economic growth by contributing to the
2 development of public facilities, to reduce its ad valorem tax
3 millage rate, or to reduce or eliminate non-ad valorem
4 assessments.
5 2. A portion of the balance of the surcharge proceeds
6 shall be used by the governing authority to increase its
7 budget reserves; however, the governing authority shall not
8 reduce the amount it allocates for budget reserves from other
9 sources below the amount allocated for reserves in the fiscal
10 year prior to the year in which the surcharge is initially
11 imposed. When a 15-percent budget reserve is achieved, based
12 on the average gross revenue for the most recent 3 prior
13 fiscal years, the remaining proceeds from this subparagraph
14 shall be used for the payment of annual debt service related
15 to outstanding obligations backed or secured by a covenant to
16 budget and appropriate from non-ad valorem revenues.
17 (c) This subsection is repealed on June 30, 2006.
18 Section 2. This act shall take effect upon becoming a
19 law.
