2 An act relating to optional Medicaid services;
3 amending s. 409.906, F.S.; restricting Medicaid
4 reimbursement for adult denture and children's
5 dental services rendered in a mobile dental
6 unit; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. Subsections (1) and (6) of section 409.906,
11 Florida Statutes, are amended to read:
12 409.906 Optional Medicaid services.--Subject to
13 specific appropriations, the agency may make payments for
14 services which are optional to the state under Title XIX of
15 the Social Security Act and are furnished by Medicaid
16 providers to recipients who are determined to be eligible on
17 the dates on which the services were provided. Any optional
18 service that is provided shall be provided only when medically
19 necessary and in accordance with state and federal law.
20 Nothing in this section shall be construed to prevent or limit
21 the agency from adjusting fees, reimbursement rates, lengths
22 of stay, number of visits, or number of services, or making
23 any other adjustments necessary to comply with the
24 availability of moneys and any limitations or directions
25 provided for in the General Appropriations Act or chapter 216.
26 If necessary to safeguard the state's systems of providing
27 services to elderly and disabled persons and subject to the
28 notice and review provisions of s. 216.177, the Governor may
29 direct the Agency for Health Care Administration to amend the
30 Medicaid state plan to delete the optional Medicaid service

1 known as "Intermediate Care Facilities for the Developmentally
2 Disabled." Optional services may include:
3 (1) ADULT DENTURE SERVICES.--The agency may pay for
4 dentures, the procedures required to seat dentures, and the
5 repair and reline of dentures, provided by or under the
6 direction of a licensed dentist, for a recipient who is age 21
7 or older. However, Medicaid reimbursement shall not be
8 provided for dental treatment rendered in a mobile dental
9 unit, regardless of location, with the following exceptions:
10 (a) A mobile dental unit owned or operated by the
11 Department of Health, complying with Medicaid's county health
12 department clinic services program specifications as a county
13 health department clinic services provider.
14 (b) A mobile dental unit owned by, operated by, or
15 having a contractual arrangement with a federally qualified
16 health center, complying with Medicaid's federally qualified
17 health center specifications as a federally qualified health
18 center provider.
19 (c) A mobile dental unit rendering dental services to
20 Medicaid recipients, 21 years of age and older, at nursing
21 facilities.
22 (6) CHILDREN'S DENTAL SERVICES.--The agency may pay
23 for diagnostic, preventive, or corrective procedures,
24 including orthodontia in severe cases, provided to a recipient
25 under age 21, by or under the supervision of a licensed
26 dentist. Services provided under this program include
27 treatment of the teeth and associated structures of the oral
28 cavity, as well as treatment of disease, injury, or impairment
29 that may affect the oral or general health of the individual.
30 However, Medicaid reimbursement shall not be provided for

1 dental treatment rendered in a mobile dental unit, regardless
2 of location, with the following exceptions:
3 (a) A mobile dental unit owned or operated by the
4 Department of Health, complying with Medicaid's county health
5 department clinic services program specifications as a county
6 health department clinic services provider.
7 (b) A mobile dental unit owned by, operated by, or
8 having a contractual arrangement with a federally qualified
9 health center, complying with Medicaid's federally qualified
10 health center specifications as a federally qualified health
11 center provider.
12 (c) A mobile dental unit rendering dental services to
13 Medicaid recipients, 21 years of age and older, at nursing
14 facilities.
15 Section 2. This act shall take effect upon becoming a
16 law.

22 units owned or operated by the Department of Health
providing county health department clinic services; units

qualified health center; or units rendering dental
24 services at nursing facilities to Medicaid recipients age
21 and older.
