11  The Committee on General Government Appropriations offered the
12  following:

14         Amendment to Amendment (293593) (with title amendment) 
15         On page 4, line 30, through page 5, line 15
16  remove from the amendment:  all of said lines

18  and insert in lieu thereof:  
19         (b)  As part of the agricultural protection agreement,
20  the parties shall agree that the state shall have a right to
21  buy a conservation easement or rural land protection easement
22  at the end of the 30 year term or prior to the landowner
23  transferring or selling the property, whichever is later.  If
24  the landowner tenders the easement for the purchase and the
25  state does not timely exercise its right to buy the easement
26  then the landowner shall be released from the agricultural
27  agreement.  The purchase price of the easement shall be based
28  on the value of such easement at the time the agreement is
29  entered into plus a reasonable escalator.  The escalator shall
30  not exceed 2 percent of the value of the easement at the time
31  the agreement is entered into multiplied by the number of full

HOUSE AMENDMENT Bill No. HB 1389 Amendment No. ___ (for drafter's use only) 1 calendar years from the date of the commencement of the 2 agreement. The landowner may transfer or sell the property 3 before the expiration of the 30-year term, but only if 4 property is sold subject to the agreement and the buyer 5 becomes the successor in interest to the agricultural 6 protection agreement.
