  1                      A bill to be entitled

  2         An act relating to shopping carts; amending s.

  3         506.5131, F.S.; revising the types of

  4         assessments which may be made against the owner

  5         of a shopping cart found on public property;

  6         providing a limit on fees that may be assessed

  7         against such owner; removing a condition that

  8         such fee be approved by the Department of

  9         Agriculture and Consumer Services; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 506.5131, Florida Statutes, is

15  amended to read:

16         506.5131  Return of shopping carts; assessment of fees,

17  fines, and costs.--

18         (1)  The rightful owner of any shopping cart with a

19  registered name or mark found on public property shall be

20  immediately notified of its recovery.

21         (2)  Notwithstanding any other provision of law or

22  local ordinance, no fee in excess of $500 per shopping cart,

23  fine, or costs may be assessed against the owner of a shopping

24  cart found on public property, unless the shopping cart was

25  removed from the premises or parking area of a retail

26  establishment by the owner of the shopping cart, or an

27  employee acting on the owner's behalf, and such fee, fine, or

28  cost has been approved by the Department of Agriculture and

29  Consumer Services.

30         Section 2.  This act shall take effect upon becoming a

31  law.

  2                       LEGISLATIVE SUMMARY

  3    Revises the types of assessments which may be made
      against the owner of a shopping cart found on public
  4    property. Provides that no fee greater than $500 per
      shopping cart may be assessed against the owner of a
  5    shopping cart found on public property. Removes a
      condition that such fee be approved by the Department of
  6    Agriculture and Consumer Services.
