2 An act relating to swimming pool/spa servicing
3 contractors; amending s. 489.111, F.S.;
4 providing eligibility requirements to take the
5 licensure examination for the swimming pool/spa
6 servicing contractor's license; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Subsection (2) of section 489.111, Florida
12 Statutes, is amended to read:
13 489.111 Licensure by examination.--
14 (2) A person shall be eligible for licensure by
15 examination if the person:
16 (a) Is 18 years of age;
17 (b) Is of good moral character; and
18 (c) Meets eligibility requirements according to one of
19 the following criteria:
20 1. Has received a baccalaureate degree from an
21 accredited 4-year college in the appropriate field of
22 engineering, architecture, or building construction and has 1
23 year of proven experience in the category in which the person
24 seeks to qualify. For the purpose of this part, a minimum of
25 2,000 person-hours shall be used in determining full-time
26 equivalency.
27 2. Has a total of at least 4 years of active
28 experience as a worker who has learned the trade by serving an
29 apprenticeship as a skilled worker who is able to command the
30 rate of a mechanic in the particular trade or as a foreman who
31 is in charge of a group of workers and usually is responsible

1 to a superintendent or a contractor or his or her equivalent,
2 provided, however, that at least 1 year of active experience
3 shall be as a foreman.
4 3. Has a combination of not less than 1 year of
5 experience as a foreman and not less than 3 years of credits
6 for any accredited college-level courses; has a combination of
7 not less than 1 year of experience as a skilled worker, 1 year
8 of experience as a foreman, and not less than 2 years of
9 credits for any accredited college-level courses; or has a
10 combination of not less than 2 years of experience as a
11 skilled worker, 1 year of experience as a foreman, and not
12 less than 1 year of credits for any accredited college-level
13 courses. For the number of years of credits for any accredited
14 college-level courses, the applicant shall show completion of
15 an equal number of courses in the appropriate field of
16 engineering, architecture, or building construction. All
17 junior college or community college-level courses shall be
18 considered accredited college-level courses.
19 4.a. An active certified residential contractor is
20 eligible to take the building contractors' examination if he
21 or she possesses a minimum of 3 years of proven experience in
22 the classification in which he or she is certified.
23 b. An active certified residential contractor is
24 eligible to take the general contractors' examination if he or
25 she possesses a minimum of 4 years of proven experience in the
26 classification in which he or she is certified.
27 c. An active certified building contractor is eligible
28 to take the general contractors' examination if he or she
29 possesses a minimum of 4 years of proven experience in the
30 classification in which he or she is certified.

1 5.a. An active certified air-conditioning Class C
2 contractor is eligible to take the air-conditioning Class B
3 contractors' examination if he or she possesses a minimum of 3
4 years of proven experience in the classification in which he
5 or she is certified.
6 b. An active certified air-conditioning Class C
7 contractor is eligible to take the air-conditioning Class A
8 contractors' examination if he or she possesses a minimum of 4
9 years of proven experience in the classification in which he
10 or she is certified.
11 c. An active certified air-conditioning Class B
12 contractor is eligible to take the air-conditioning Class A
13 contractors' examination if he or she possesses a minimum of 1
14 year of proven experience in the classification in which he or
15 she is certified.
16 6.a. An active certified swimming pool servicing
17 contractor is eligible to take the residential swimming pool
18 contractors' examination if he or she possesses a minimum of 3
19 years of proven experience in the classification in which he
20 or she is certified.
21 b. An active certified swimming pool servicing
22 contractor is eligible to take the swimming pool commercial
23 contractors' examination if he or she possesses a minimum of 4
24 years of proven experience in the classification in which he
25 or she is certified.
26 c. An active certified residential swimming pool
27 contractor is eligible to take the commercial swimming pool
28 contractors' examination if he or she possesses a minimum of 1
29 year of proven experience in the classification in which he or
30 she is certified.

1 d. An applicant is eligible to take the swimming
2 pool/spa servicing contractor's examination if he or she has
3 satisfactorily completed 60 hours of instruction in courses
4 related to the scope of work covered by that license and
5 approved by the Construction Industry Licensing Board by rule
6 and has at least 1 year of proven experience related to the
7 scope of work of such a contractor.
8 Section 2. This act shall take effect July 1, 2001.
