14 Amendment (with title amendment)
15 On page 45, between lines 30 and 31 of the bill
16
17 insert:
18 Section 12. Subsection (3) of s. 943.053, F.S., is
19 amended to read:
20
21 943.053 Dissemination of criminal justice information;
22 fees.--
23
24 (3) Criminal history information, including information
25 relating to minors, compiled by the Criminal Justice
26 Information Program from intrastate sources shall be available
27 on a priority basis to criminal justice agencies for criminal
28 justice purposes free of charge and, otherwise, to
29 governmental agencies not qualified as criminal justice
30 agencies on an approximate-cost basis. After providing the
31 program with all known identifying information, persons in the

1 private sector may be provided criminal history information
2 upon tender of fees as established and the manner prescribed
3 by rule of the Department of Law Enforcement. Such fees shall
4 approximate the actual cost of producing the record
5 information. As used herein, the department's determination
6 of actual cost shall take into account the total cost of
7 creating, storing, maintaining, updating, retrieving,
8 improving, and providing criminal history information in a
9 centralized, automated database, including personnel,
10 technology and infrastructure expenses. Actual cost shall be
11 computed on a fee per record basis, and any access to criminal
12 history information to the private sector as provided herein
13 shall be assessed the per record fee without regard to the
14 quantity or category of criminal history record information
15 requested. Fees may be waived by the executive director of
16 the Department of Law Enforcement for good cause shown.
