15 On page 45, between lines 30, and 31, of the bill
16
17 insert:
18 Section 11. Section 985.3065, Florida Statutes, is
19 amended to read:
20 985.3065 Prearrest or postarrest diversion programs.--
21 (1) A law enforcement agency or school district, in
22 cooperation with the state attorney, may establish a prearrest
23 diversion program.
24 (2) As part of the prearrest or postarrest diversion
25 program, a child who is alleged to have committed a delinquent
26 act may be required to surrender his or her driver's license,
27 or refrain from applying for a driver's license, for not more
28 than 90 days. If the child fails to comply with the
29 requirements of the program, the state attorney may notify the
30 Department of Highway Safety and Motor Vehicles in writing to
31 suspend the child's driver's license for a period that may not

1 exceed 90 days.
2 (3) The prearrest or postarrest diversion program may,
3 upon agreement of the agencies which establish the program,
4 provide for the expunction of the nonjudicial arrest record of
5 a minor who successfully completes such a program pursuant to
6 s. 943.0582.
