1 A bill to be entitled
2 An act relating to enterprise zones;
3 authorizing the Office of Tourism, Trade, and
4 Economic Development to amend the boundaries of
5 an enterprise zone upon application by certain
6 counties; providing requirements with respect
7 thereto; creating s. 290.00694, F.S.;
8 authorizing the Office of Tourism, Trade, and
9 Economic Development to designate an enterprise
10 zone in Sarasota County; providing requirements
11 with respect thereto; amending s. 290.00555,
12 F.S.; removing the December 31, 1999, deadline
13 for creation of satellite enterprise zones by
14 certain municipalities and authorizing creation
15 of such zones effective retroactively to that
16 date; providing duties of the Office of
17 Tourism, Trade, and Economic Development;
18 providing an application deadline for
19 businesses in such zones eligible for certain
20 sales and use tax incentives; providing for
21 designation of a specified area within
22 Hillsborough County as an enterprise zone;
23 providing an effective date.

25 Be It Enacted by the Legislature of the State of Florida:
26
27 Section 1. Notwithstanding any provision of law to the
28 contrary, the governing body of an inland county with a
29 state-designated enterprise zone and a population greater than
30 500,000 may apply to the Office of Tourism, Trade, and
31 Economic Development to amend the boundaries of one

1 noncontiguous area of an enterprise zone. The office shall
2 approve the application so long as the amended area does not
3 exceed 4 square miles and is consistent with the categories,
4 criteria, and limitations imposed by s. 290.0055, Florida
5 Statutes, upon the establishment of such enterprise zone. The
6 enterprise zone boundary amendment application must be
7 received before December 31, 2001.
8 Section 2. Section 290.00694, Florida Statutes, is
9 created to read:
10 290.00694 Enterprise zone designation for Sarasota
11 County or Sarasota County and Sarasota.--Sarasota County, or
12 Sarasota County and the City of Sarasota jointly, may apply to
13 the Office of Tourism, Trade, and Economic Development for
14 designation of one enterprise zone within the county, or
15 within both the county and the municipality, which zone
16 encompasses an area that is south of the north county line,
17 west of Tuttle Avenue, north of 10th Street, and east of U.S.
18 Highway 41. The application must be submitted by December 31,
19 2001, and must comply with the requirements of s. 290.0055.
20 Notwithstanding the provisions of s. 290.0065 limiting the
21 total number of enterprise zones designated and the number of
22 enterprise zones within a population category, the Office of
23 Tourism, Trade, and Economic Development may designate one
24 enterprise zone under this section. The Office of Tourism,
25 Trade, and Economic Development shall establish the initial
26 effective date of the enterprise zone designated under this
27 section.
28 Section 3. Section 290.00555, Florida Statutes, is
29 amended to read:
30 290.00555 Satellite enterprise zones.--Before December
31 31, 1999, Any municipality an area of which has previously

1 received designation as an Enterprise Zone in the population
2 category described in s. 290.0065(3)(a)3. may create a
3 satellite enterprise zone not exceeding 1.5 square miles in
4 area outside of and, notwithstanding anything contained in s.
5 290.0055(4), or any other law, in addition to the previously
6 designated enterprise zone boundaries. The Office of Tourism,
7 Trade, and Economic Development shall amend the boundaries of
8 the areas previously designated by any such municipality as
9 enterprise zones upon receipt of a resolution adopted by the
10 municipality describing the satellite enterprise zone areas,
11 as long as the additional areas are consistent with the
12 categories, criteria, and limitations imposed by s. 290.0055.
13 However, the requirements imposed by s. 290.0055(4)(d) do not
14 apply to such satellite enterprise zone areas.
15 Section 4. Satellite enterprise zones may be created
16 pursuant to s. 290.00555, Florida Statutes, effective
17 retroactively to December 31, 1999. Resolutions adopted to
18 create satellite enterprise zones under this section must be
19 submitted to the Office of Tourism, Trade, and Economic
20 Development no later that August 1, 2001. The Office of
21 Tourism, Trade, and Economic Development must amend the
22 boundaries of previously designated enterprise zones to create
23 eligible satellite enterprise zones no later than September 1,
24 2001. Notwithstanding the time limitations contained in
25 chapter 212, Florida Statutes, a business in a satellite
26 enterprise zone designated under this section which was
27 eligible to receive tax incentives pursuant to ss.
28 212.08(5)(g) and (h) and 212.096, Florida Statutes, during the
29 period beginning December 31, 1999, and ending on the date of
30 the creation of the satellite enterprise zone must submit an
31 application for the tax incentives by December 1, 2001. All

1 other requirements of the enterprise zone program apply to
2 such a business.
3 Section 5. Enterprise zone designation for
4 Hillsborough County.--Hillsborough County may apply to the
5 Office of Tourism, Trade, and Economic Development for
6 designation of one enterprise zone within the county, which
7 zone encompasses a high-crime, low-income, high-unemployment
8 area that is north of Fowler Avenue, south of Bearss Avenue,
9 east of Florida Avenue, west of Bruce B. Downs Boulevard, near
10 the University of South Florida, adjacent to University Square
11 Mall, north of a major theme park, an area that has been
12 designated a federal Weed & Seed target area, and a Community
13 Development Block Grant (CDBG) target area and that houses an
14 active public/private 501(c)(3) community development
15 corporation working to improve the area. The application must
16 be submitted by December 31, 2002, and must comply with the
17 requirements of section 290.0055, Florida Statutes.
18 Notwithstanding the provisions of section 290.0065, Florida
19 Statutes, limiting the total number of enterprise zones
20 designated and the number of enterprise zones within a
21 population category, the Office of Tourism, Trade, and
22 Economic Development may designate one enterprise zone under
23 this section. The Office of Tourism, Trade, and Economic
24 Development shall establish the initial effective date of the
25 enterprise zone designated under this section.
26 Section 6. This act shall take effect upon becoming a
27 law.
