  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Digital Divide Trust Fund within the Executive

  4         Office of the Governor; providing for sources

  5         of moneys and purposes; providing for future

  6         review and termination or re-creation of the

  7         trust fund; providing a contingent effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  The Digital Divide Trust Fund is created,

13  to be administered by the Office of Information Technology

14  within the Executive Office of the Governor. Funds shall be

15  credited to the trust fund as provided in SB .... or similar

16  legislation, to be used for the purposes set forth therein.

17         Section 2.  (1)  Pursuant to the provisions of Section

18  19(f)(2), Article III of the State Constitution, the Digital

19  Divide Trust Fund shall, unless terminated sooner, be

20  terminated on July 1, 2005.

21         (2)  Prior to the regular legislative session

22  immediately preceding the date on which the trust fund is

23  scheduled to be terminated, the Governor shall recommend to

24  the President of the Senate and the Speaker of the House of

25  Representatives whether the trust fund should be allowed to

26  terminate or should be re-created.  These recommendations

27  shall be based on a review of the purpose and use of the trust

28  fund and a determination of whether the trust fund will

29  continue to be necessary.  A recommendation to re-create the

30  trust fund may include suggested modifications to the

31  purposes, sources of receipts, and allowable expenditures for

  1  the trust fund. The Governor's recommendation shall be made as

  2  a part of the recommended budget presented to the Legislature

  3  pursuant to section 216.162, Florida Statutes.

  4         (3)  If the trust fund is terminated, the Executive

  5  Office of the Governor shall pay any outstanding debts or

  6  obligations of the trust fund as soon as practicable and the

  7  Comptroller shall close out and remove the trust fund from the

  8  various state accounting systems, using generally accepted

  9  accounting practices concerning warrants outstanding, assets,

10  and liabilities.

11         Section 3.  This act shall take effect July 1, 2001, if

12  SB .... or similar legislation is adopted in the same

13  legislative session or an extension thereof.
