1 A bill to be entitled
2 An act relating to the Florida Retirement
3 System; amending s. 409.9205, F.S.;
4 transferring positions in the Medicaid Fraud
5 Control Unit of the Department of Legal Affairs
6 to Career Service System; eliminating a
7 provision that makes investigators of the
8 Medicaid Fraud Control Unit ineligible for
9 membership in the Special Risk Class of the
10 system; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 409.9205, Florida Statutes, is
15 amended to read:
16 409.9205 Medicaid Fraud Control Unit; law enforcement
17 officers.--
18 (1) Except as provided in s. 110.205, all positions in
19 the Medicaid Fraud Control Unit of the Department of Legal
20 Affairs are transferred to the Career Service System.
21 (2) All investigators employed by the Medicaid Fraud
22 Control Unit who have been certified under s. 943.1395 are law
23 enforcement officers of the state. Such investigators have the
24 authority to conduct criminal investigations, bear arms, make
25 arrests, and apply for, serve, and execute search warrants,
26 arrest warrants, capias, and other process throughout the
27 state pertaining to Medicaid fraud as described in this
28 chapter. The Attorney General shall provide reasonable notice
29 of criminal investigations conducted by the Medicaid Fraud
30 Control Unit to, and coordinate those investigations with, the
31 sheriffs of the respective counties. Investigators employed by

1 the Medicaid Fraud Control Unit are not eligible for
2 membership in the Special Risk Class of the Florida Retirement
3 System under s. 121.0515.
4 Section 2. This act shall take effect July 1, 2001.

6 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

9 The Committee additionally transfers the remaining members of
the Medicaid Fraud Control unit back to the Career Service
10 System, except for those retained in the Selected Exempt
Service system.
