  1                      A bill to be entitled

  2         An act relating to the State Group Insurance

  3         Program; amending ss. 110.123 and 287.022,

  4         F.S.; prohibiting the Department of Management

  5         Services or the Division of State Group

  6         Insurance from prohibiting or limiting

  7         competition for certain insurance products or

  8         plans on an agent compensation arrangement

  9         basis; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Paragraph (i) is added to subsection (3) of

14  section 110.123, Florida Statutes, to read:

15         110.123  State group insurance program.--

16         (3)  STATE GROUP INSURANCE PROGRAM.--

17         (i)  The Department of Management Services or the

18  Division of State Group Insurance of the department shall not

19  prohibit or limit any properly licensed insurer, health

20  maintenance organization, prepaid limited health services

21  organization, or insurance agent from competing for any

22  insurance product or plan purchased, provided, or endorsed by

23  the department or the division on the basis of the

24  compensation arrangement used by the insurer or organization

25  for its agents.

26         Section 2.  Subsection (3) is added to section 287.022,

27  Florida Statutes, to read:

28         287.022  Purchase of insurance.--

29         (3)  The Department of Management Services or the

30  Division of State Group Insurance of the department shall not

31  prohibit or limit any properly licensed insurer, health

  2  organization, or insurance agent from competing for any

  3  insurance product or plan purchased, provided, or endorsed by

  6  for its agents.

  7         Section 3.  This act shall take effect upon becoming a

  8  law.
