2 An act relating to Medicaid environmental
3 modification services; creating s. 409.9072,
4 F.S.; providing for Medicaid enrollment of
5 licensed general, building, and residential
6 contractors as providers of environmental
7 modification services for Medicaid recipients
8 under any home and community-based services
9 waiver program; providing a definition;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 409.9072, Florida Statutes, is
15 created to read:
16 409.9072 Medicaid provider agreement for environmental
17 modification services.--Notwithstanding any other provision of
18 law, Medicaid shall enroll any general, building, or
19 residential contractor who is licensed pursuant to chapter
20 489, as a provider of environmental modification services for
21 any Medicaid home and community-based services waiver program,
22 after such contractor signs the required Medicaid provider
23 agreement. For purposes of this section, "environmental
24 modification services," also known as "environmental
25 accessibility adaptations," means those physical adaptations
26 to the home required by a Medicaid recipient's plan of care
27 that are necessary to ensure the health, safety, and welfare
28 of the recipient or to enable such person to function with
29 greater independence and prevent his or her
30 institutionalization.
31 Section 2. This act shall take effect October 1, 2001.

4 The Committee Substitute for Senate Bill 1520 removes from the
bill requirements that the Department of Elderly Affairs and
5 the Department of Children and Family Services develop
expedited approval of providers of environmental modification
6 services under the Assisted Living for the Elderly Medicaid
waiver and the developmental services waiver, replacing this
7 requirement with a requirement that Medicaid enroll any
general, building, or residential contractor licensed under
8 ch. 489, F.S., as a provider of environmental modification
services for any Medicaid home and community-based services
9 waiver; and defines "environmental modification services" and
"environmental accessibility adaptations".
