  1                      A bill to be entitled

  2         An act relating to long-term care; creating the

  3         "Moses General Miles Act"; authorizing the

  4         Institute on Urban Policy and Commerce at

  5         Florida Agricultural and Mechanical University

  6         to develop a grant program for pilot projects

  7         in assisted living facility long-term care for

  8         elderly persons in urban distressed

  9         communities; providing for eligibility and

10         priority for funding; creating a review panel

11         to evaluate proposed pilot projects; providing

12         membership of the review panel; directing the

13         institute to provide program technical

14         assistance support; providing rulemaking

15         authority; providing an appropriation;

16         providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19

20         Section 1.  This act may be cited as the "Moses General

21  Miles Act."

22         Section 2.  (1)  For the purpose of establishing a

23  long-term residential care continuum of assisted living

24  facilities for low-income elderly living in urban distressed

25  communities, and as an additional source for community

26  economic development opportunities in specific targeted areas,

27  the Institute on Urban Policy and Commerce at Florida

28  Agricultural and Mechanical University is authorized to

29  develop a grant program to fund five pilot projects to be

30  located in 5 of the 10 urban distressed communities of

31  Pensacola, Tallahassee, Jacksonville, Daytona Beach, Orlando,

  1  Tampa, St. Petersburg, West Palm Beach, Ft. Lauderdale, and

  2  Miami-Dade. The funding for the five pilot projects shall be

  3  provided to not-for-profit community and faith-based

  4  organizations located in urban distressed communities. Each

  5  organization seeking funding shall submit to a review panel a

  6  strategic plan that outlines the need for and the location of

  7  assisted living facilities for low-income elderly in the urban

  8  distressed communities. The plan should incorporate

  9  public-private partnerships that will be used for the

10  development and construction of the assisted living facilities

11  in the urban distressed communities. To be eligible for

12  funding under this program, a not-for-profit community and

13  faith-based organization must hold a current exemption from

14  federal taxation under s. 501(c)(3) or (4) of the Internal

15  Revenue Code. The institute shall develop criteria for the

16  review of the plans. The institute shall give priority

17  consideration for funding under this program to plans

18  submitted by neighborhood-based organizations that have as a

19  principal part of their missions the improvement of conditions

20  for residents of the neighborhoods in which the organizations

21  are located. The institute shall develop weighted criteria to

22  be used in evaluating applications from the community and

23  faith-based organizations.

24         (2)  A review panel is created within the institute to

25  evaluate proposals for award of funding for the five pilot

26  projects. The review panel shall consist of seven members

27  appointed by the President of Florida Agricultural and

28  Mechanical University, as follows:

29         (a)  One member who is affiliated with the Agency for

30  Health Care Administration.

  1         (b)  The Secretary of Health, or the secretary's

  2  designee.

  3         (c)  The president of Enterprise Florida, Inc., or the

  4  president's designee.

  5         (d)  One member who is from a private-sector investment

  6  institution or organization.

  7         (e)  One member who is affiliated with the Office of

  8  Tourism, Trade, and Economic Development.

  9         (f)  One member who is from a professional trade

10  organization representing long-term-care assisted living

11  facilities.

12         (g)  One member who is affiliated with Workforce

13  Florida, Inc.

15  The director of the institute, or a designee, shall serve as

16  secretary to the review panel without voting rights.

17         (3)  The institute shall develop and provide program

18  technical assistance support to the community and faith-based

19  organizations interested in this community economic

20  development initiative.

21         (4)  The institute has the authority to adopt rules to

22  implement the provisions of his section.

23         Section 3.  There is appropriated from the General

24  Revenue Fund to the Institute on Urban Policy and Commerce at

25  Florida Agricultural and Mechanical University the sum of $1.5

26  million to develop and provide program technical assistance

27  support to community and faith-based organizations, and for

28  contracts for five pilot projects, pursuant to this act. The

29  institute is authorized to allocate up to $225,000 to each of

30  the five pilot projects.

31         Section 4.  This act shall take effect July 1, 2001.
