1 A bill to be entitled
2 An act relating to the Florida Election Code;
3 amending s. 101.27, F.S.; prohibiting the use
4 of a punch-card ballot to tabulate votes;
5 amending s. 101.28, F.S.; requiring that voting
6 machines be equipped to reject a ballot and
7 notify the elector if the elector fails to cast
8 certain votes or votes for more candidates than
9 the elector is entitled to vote for; providing
10 an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsections (1) and (2) of section 101.27,
15 Florida Statutes, are amended to read:
16 101.27 Voting machine ballots.--
17 (1) All ballots for voting machines shall be printed
18 on strips of white cardboard, paper, or other material of such
19 size as will fill the ballot frames of the machine, in plain
20 black type as large as the space will permit, so as to show
21 the name of the candidate, statement of the proposed
22 constitutional amendment, or other question or proposition
23 submitted to the electorate at any election. A punch-card
24 ballot may not be used for tabulating votes for any election.
25 (2) The captions on the ballots for voting machines
26 shall be placed so as to indicate to the elector what push
27 knob, key, lever, or other device is used or operated in order
28 to cast his or her vote for or against a candidate, proposed
29 constitutional amendment, or other question or proposition
30 submitted to the electorate at any election.

1 Section 2. Paragraph (l) is added to subsection (1) of
2 section 101.28, Florida Statutes, to read:
3 101.28 Requirements for voting machines.--All voting
4 machines purchased for use in this state shall meet the
5 following minimum requirements:
6 (1) Each voting machine shall:
7 (l) Be equipped so that a ballot is rejected at the
8 time the vote is cast and the elector is immediately notified
9 of a spoiled ballot or an error in voting so that the elector
10 may cast an accurate vote if the elector:
11 1. Fails to vote for any candidate for an office that
12 the elector has the right to vote upon.
13 2. Fails to vote for or against any proposed
14 constitutional amendment or other question or proposition that
15 the elector has the right to vote upon.
16 3. Votes for more candidates for an office than the
17 elector has the right to vote upon.
18 Section 3. This act shall take effect July 1, 2001.

21 SENATE SUMMARY
22 Prohibits the supervisor of elections from using a
punch-card ballot to tabulate votes. Requires that a
23 voting machine reject a ballot and notify the elector of
an error if the elector fails to vote for a candidate for
24 an office or votes for more candidates than the elector
is entitled to vote for.
