14         Senate Amendment (with title amendment) 
15         On page 206, line 3 through page 207, line 15, delete
16  those lines
17  
18  and insert:  
19         Section 71.  Paragraphs (a) and (c) of subsection (9)
20  of section 456.073, Florida Statutes, are amended, to read:
21         456.073  Disciplinary proceedings.--Disciplinary
22  proceedings for each board shall be within the jurisdiction of
23  the department.
24         (9)(a)  The department shall periodically notify the
25  person who filed the complaint, as well as the patient or the
26  patient's legal representative, of the status of the
27  investigation, indicating whether probable cause has been
28  found and the status of any civil action or administrative
29  proceeding or appeal.
30         (c)  In any disciplinary case for which probable cause
31  is not found, the department shall so inform the person who

SENATE AMENDMENT Bill No. CS for SB 1558, 1st Eng. Amendment No. ___ Barcode 782880 1 filed the complaint and notify that person that he or she may, 2 within 60 days, provide any additional information to the 3 department probable cause panel which may be relevant to the 4 decision. To facilitate the provision of additional 5 information, the person who filed the complaint may receive, 6 upon request, a copy of the department's expert report that 7 supported the recommendation for closure, if such a report was 8 relied upon by the department. In no way does this require the 9 department to procure an expert opinion or report if none was 10 used. Additionally, the identity of the expert shall remain 11 confidential. In any administrative proceeding under s. 12 120.57, the person who filed the disciplinary complaint shall 13 have the right to present oral or written communication 14 relating to the alleged disciplinary violations or to the 15 appropriate penalty. 16 17 18 ================ T I T L E A M E N D M E N T =============== 19 And the title is amended as follows: 20 On page 293, lines 10-12, delete those lines 21 22 and insert: 23 amending s. 456.074, F.S.; 24 25 26 27 28 29 30 31 2 12:48 PM 05/03/01 s1558.hc25.w1
