1 A bill to be entitled
2 An act relating to the Department of
3 Environmental Protection; directing the
4 Department of Environmental Protection to
5 establish a pilot project to test the
6 cost-effectiveness of publication of notices on
7 the Internet in lieu of publication in the
8 Florida Administrative Weekly; providing that
9 the Department of Environmental Protection
10 shall submit a report on the cost-effectiveness
11 of publication of such notices on the Internet;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. (1) On or before December 31, 2001, the
17 Department of Environmental Protection shall establish and
18 commence a pilot project to determine the cost-effectiveness
19 of publication of notices on the Internet in lieu of
20 publication in the Florida Administrative Weekly. The pilot
21 project shall end on July 1, 2003. Under this pilot project,
22 notwithstanding any other provision of the Florida Statutes,
23 whenever the Department of Environmental Protection is
24 required to publish notices in the Florida Administrative
25 Weekly, in lieu of publication in the Florida Administrative
26 Weekly, the Department of Environmental Protection shall
27 publish such notices on the Internet. Notices published on the
28 Internet under this provision shall clearly state the date the
29 notice was first posted on the Internet, shall be posted only
30 on the same days the Florida Administrative Weekly is
31 published, and shall comply with the form and content

1 provision of rules 1S-1.002-1S-1.004, Florida Administrative
2 Code. Notices related to proposed rule development and
3 proposed rulemaking published on the Internet under this
4 provision shall be maintained on the Internet for a period of
5 12 months after the effective date of the rule or 3 months
6 after the publication of a notice of withdrawal of the
7 proposed rule. All other notices published on the Internet
8 under this provision shall be maintained on the Internet for a
9 period of 3 months after the date first posted.
10 (2) The Department of Environmental Protection shall
11 publish notice of this pilot project in each weekly
12 publication of the Florida Administrative Weekly. The notice
13 shall state: "Under a temporary pilot project to determine
14 the cost-effectiveness of Internet publication of notices in
15 lieu of publication in the Florida Administrative Weekly,
16 notices of the Department of Environmental Protection are
17 being published on the Internet at the following Internet URL
18 or address: http://www.dep.state.fl.us."
19 (3) Based on information obtained from the date of
20 commencement of the pilot project through December 31, 2002,
21 the Department of Environmental Protection, on January 31,
22 2003, shall report to the Governor, the President of the
23 Senate, and the Speaker of the House of Representatives its
24 findings on the cost-effectiveness of publication of notices
25 on the Internet in lieu of publication in the Florida
26 Administrative Weekly.
27 Section 2. This act shall take effect July 1, 2001.
