  1                      A bill to be entitled

  2         An act relating to motor vehicle airbags;

  3         creating s. 860.146, F.S.; prohibiting the

  4         installation or reinstallation in a motor

  5         vehicle of anything other than a new or

  6         salvaged airbag designed in accordance with

  7         certain federal safety standards; providing a

  8         felony penalty; providing for application of

  9         certain recordkeeping requirements and

10         penalties; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

14         Section 1.  Section 860.146, Florida Statutes, is

15  created to read:

16         860.146  Motor vehicle replacement airbags.--

17         (1)  It is unlawful for any person to install or

18  reinstall in a motor vehicle any object in lieu of a new or

19  salvaged airbag that was designed in accordance with federal

20  safety standards for the make, model, and year of that vehicle

21  as part of a motor vehicle inflatable restraint system. Any

22  person who violates this section commits a felony of the

23  second degree, punishable as provided in s. 775.082, s.

24  775.083, or s. 775.084.

25         (2)  The provisions of s. 860.145(2), (3), and (4)(b)

26  apply to this section.

27         Section 2.  This act shall take effect July 1, 2001.
