8 s. 290.00696, F.S.; authorizing the Office of
9 Tourism, Trade, and Economic Development to
10 designate an enterprise zone in Holmes County;
11 providing requirements with respect thereto;
12 creating s. 290.00697, F.S.; authorizing the
13 Office of Tourism, Trade, and Economic
14 Development to designate an enterprise zone in
15 Calhoun County; providing requirements with
16 respect thereto; creating s. 290.00698, F.S.;
17 authorizing the Office of Tourism, Trade, and
18 Economic Development to designate an enterprise
19 zone in Okaloosa County; providing requirements
20 with respect thereto; creating s. 290.00694,
21 F.S.; authorizing the Office of Tourism, Trade,
22 and Economic Development to designate an
23 enterprise zone in Sarasota County; providing
24 requirements with respect thereto; amending s.
25 290.00555, F.S.; removing the December 31,
26 1999, deadline for creation of satellite
27 enterprise zones by certain municipalities and
28 authorizing creation of such zones effective
29 retroactively to that date; providing duties of
30 the Office of Tourism, Trade, and Economic
31 Development; providing an application deadline

2 certain sales and use tax incentives; providing

5 Be It Enacted by the Legislature of the State of Florida:
6
7 Section 1. Section 290.00695, Florida Statutes, is
8 created to read:
9 290.00695 Enterprise zone designation for Hernando
10 County or Hernando County and Brooksville.--Hernando County,
11 or Hernando County and the City of Brooksville jointly, may
12 apply to the Office of Tourism, Trade, and Economic
13 Development for designation of one enterprise zone within the
14 county, or within both the county and the city, which zone
15 encompasses an area up to 10 contiguous square miles starting
16 north of the City of Brooksville with properties within the
17 Gregg Mine Industrial Park; those lands located on the east
18 side of Cobb Road south of Yontz Road to the intersection of
19 Jefferson Street and State Road 50; lands adjacent to the
20 State Road 50 Bypass east to the intersection of Jefferson
21 Street and State Road 50 in the southeast area of the City of
22 Brooksville; those lands encompassing the areas north and
23 south of Summit Road from Hale Avenue to the west, east to
24 Jefferson Street; lands adjacent to U.S. Route 41 from the
25 State Road 50 Bypass south to the proposed Ayers Road
26 Extension; those lands encompassing the Hernando County
27 Airport east of U.S. Route 41 west to the Suncoast Parkway
28 with Spring Hill Drive and Powell Road to the north including
29 portions along Spring Hill Drive east and west of the
30 intersection with California Street; and those lands adjacent
31 to Anderson Snow Road and Corporate Boulevard known as Holland

1 Springs Industrial Park. The application must be submitted by
2 December 31, 2001, and must comply with the requirements of s.
3 290.0055. Notwithstanding the provisions of s. 290.0065
4 limiting the total number of enterprise zones designated and
5 the number of enterprise zones within a population category
6 and the provisions of s. 290.0058 setting forth pervasive
7 poverty, unemployment, and general distress criteria, the
8 Office of Tourism, Trade, and Economic Development may
9 designate one enterprise zone under this section. The Office
10 of Tourism, Trade, and Economic Development shall establish
11 the initial effective date of the enterprise zone designated
12 under this section.
13 Section 2. Section 290.00696, Florida Statutes, is
14 created to read:
15 290.00696 Enterprise zone designation for Holmes
16 County.--Holmes County may apply to the Office of Tourism,
17 Trade, and Economic Development for designation of one
18 enterprise zone within an area in Holmes County. The
19 application must be submitted by December 31, 2001, and must
20 comply with the requirements of s. 290.0055. Notwithstanding
21 the provisions of s. 290.0065 limiting the total number of
22 enterprise zones designated and the number of enterprise zones
23 within a population category, the Office of Tourism, Trade,
24 and Economic Development may designate one enterprise zone
25 under this section. The Office of Tourism, Trade, and Economic
26 Development shall establish the initial effective date of the
27 enterprise zone designated pursuant to this section.
28 Section 3. Section 290.00697, Florida Statutes, is
29 created to read:
30 290.00697 Enterprise zone designation for Calhoun
31 County.--Calhoun County may apply to the Office of Tourism,

1 Trade, and Economic Development for designation of one
2 enterprise zone within an area in Calhoun County. The
3 application must be submitted by December 31, 2001, and must
4 comply with the requirements of s. 290.0055, except subsection
5 (3) thereof. Notwithstanding the provisions of s. 290.0065
6 limiting the total number of enterprise zones designated and
7 the number of enterprise zones within a population category,
8 the Office of Tourism, Trade, and Economic Development may
9 designate one enterprise zone under this section. The Office
10 of Tourism, Trade, and Economic Development shall establish
11 the initial effective date of the enterprise zone designated
12 pursuant to this section.
13 Section 4. Section 290.00698, Florida Statutes, is
14 created to read:
15 290.00698 Enterprise zone designation for Okaloosa
16 County.--Okaloosa County may apply to the Office of Tourism,
17 Trade, and Economic Development for designation of one
18 enterprise zone within an area in Okaloosa County, which zone
19 encompasses an area up to 6 square miles. The application
20 must be submitted by December 31, 2001, and must comply with
21 the requirements of s. 290.0055, except subsection (3)
22 thereof. Notwithstanding the provisions of s. 290.0065
23 limiting the total number of enterprise zones designated and
24 the number of enterprise zones within a population category,
25 the Office of Tourism, Trade, and Economic Development may
26 designate one enterprise zone under this section. The Office
27 of Tourism, Trade, and Economic Development shall establish
28 the initial effective date of the enterprise zone designated
29 pursuant to this section.
30 Section 5. Section 290.00694, Florida Statutes, is
31 created to read:

1 290.00694 Enterprise zone designation for Sarasota
2 County or Sarasota County and Sarasota.--Sarasota County, or
3 Sarasota County and the City of Sarasota jointly, may apply to
4 the Office of Tourism, Trade, and Economic Development for
5 designation of one enterprise zone within the county, or
6 within both the county and the municipality, which zone
7 encompasses an area that is south of the north county line,
8 west of Tuttle Avenue, north of 10th Street, and east of U.S.
9 Highway 41. The application must be submitted by December 31,
10 2001, and must comply with the requirements of s. 290.0055.
11 Notwithstanding the provisions of s. 290.0065 limiting the
12 total number of enterprise zones designated and the number of
13 enterprise zones within a population category, the Office of
14 Tourism, Trade, and Economic Development may designate one
15 enterprise zone under this section. The Office of Tourism,
16 Trade, and Economic Development shall establish the initial
17 effective date of the enterprise zone designated under this
18 section.
19 Section 6. Section 290.00555, Florida Statutes, is
20 amended to read:
21 290.00555 Satellite enterprise zones.--Before December
22 31, 1999, Any municipality an area of which has previously
23 received designation as an enterprise zone in the population
24 category described in s. 290.0065(3)(a)3. may create a
25 satellite enterprise zone not exceeding 1.5 square miles in
26 area outside of and, notwithstanding anything contained in s.
27 290.0055(4), or any other law, in addition to the previously
28 designated enterprise zone boundaries. The Office of Tourism,
29 Trade, and Economic Development shall amend the boundaries of
30 the areas previously designated by any such municipality as
31 enterprise zones upon receipt of a resolution adopted by the

1 municipality describing the satellite enterprise zone areas,
2 as long as the additional areas are consistent with the
3 categories, criteria, and limitations imposed by s. 290.0055.
4 However, the requirements imposed by s. 290.0055(4)(d) do not
5 apply to such satellite enterprise zone areas.
6 Section 7. Satellite enterprise zones may be created
7 pursuant to s. 290.00555, Florida Statutes, effective
8 retroactively to December 31, 1999. Resolutions adopted to
9 create satellite enterprise zones under this section must be
10 submitted to the Office of Tourism, Trade, and Economic
11 Development no later than August 1, 2001. The Office of
12 Tourism, Trade, and Economic Development must amend the
13 boundaries of previously designated enterprise zones to create
14 eligible satellite enterprise zones no later than September 1,
15 2001. Notwithstanding the time limitations contained in
16 chapter 212, Florida Statutes, a business in a satellite
17 enterprise zone designated under this section which was
18 eligible to receive tax incentives pursuant to ss.
19 212.08(5)(g) and (h) and 212.096, Florida Statutes, during the
20 period beginning December 31, 1999, and ending on the date of
21 the creation of the satellite enterprise zone must submit an
22 application for the tax incentives by December 1, 2001. All
23 other requirements of the enterprise zone program apply to
24 such a business.
25 Section 8. This act shall take effect upon becoming a
26 law.

4 The committee substitute for committee substitute for SB 158
allows:

1) Hernando County or Hernando County and the City of
6 Brooksville jointly;
7 2) Holmes County;
8 3) Calhoun County;
9 4) Okaloosa County; and
10 5) Sarasota County or Sarasota County and the City of
Sarasota, jointly
11
to apply to the Office of Tourism, Trade and Economic
12 Development for designation of one enterprise zone each. (The
committee substitute had allowed only Hernando County or
13 Hernando County and the City of Brooksville jointly to make
such application.) It also extends the time for a satellite
14 enterprise zone authorized under s. 290.00555, F.S., to be
created.
