14 Development to designate an enterprise zone in
15 Calhoun County; providing requirements with
16 respect thereto; creating s. 290.00698, F.S.;
17 authorizing the Office of Tourism, Trade, and
18 Economic Development to designate an enterprise
19 zone in Okaloosa County; providing requirements
20 with respect thereto; creating s. 290.00694,
21 F.S.; authorizing the Office of Tourism, Trade,
22 and Economic Development to designate an
23 enterprise zone in Sarasota County; providing
24 requirements with respect thereto; providing
25 for designation of a specified area within
26 Hillsborough County as an enterprise zone;
27 amending s. 290.00555, F.S.; removing the
28 December 31, 1999, deadline for creation of
29 satellite enterprise zones by certain
30 municipalities and authorizing creation of such
31 zones effective retroactively to that date;

1 providing duties of the Office of Tourism,
2 Trade, and Economic Development; providing an
3 application deadline for businesses in such
4 zones eligible for certain sales and use tax
5 incentives; authorizing a boundary change in a
6 specified enterprise zone; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Section 290.00695, Florida Statutes, is
12 created to read:
13 290.00695 Enterprise zone designation for Hernando
14 County or Hernando County and Brooksville.--Hernando County,
15 or Hernando County and the City of Brooksville jointly, may
16 apply to the Office of Tourism, Trade, and Economic
17 Development for designation of one enterprise zone within the
18 county, or within both the county and the city, which zone
19 encompasses an area up to 10 contiguous square miles. The
20 application must be submitted by December 31, 2001, and must
21 comply with the requirements of s. 290.0055. Notwithstanding
22 the provisions of s. 290.0065 limiting the total number of
23 enterprise zones designated and the number of enterprise zones
24 within a population category, the Office of Tourism, Trade,
25 and Economic Development may designate one enterprise zone
26 under this section. The Office of Tourism, Trade, and Economic
27 Development shall establish the initial effective date of the
28 enterprise zone designated under this section.
29 Section 2. Section 290.00696, Florida Statutes, is
30 created to read:

1 290.00696 Enterprise zone designation for Holmes
2 County.--Holmes County may apply to the Office of Tourism,
3 Trade, and Economic Development for designation of one
4 enterprise zone within an area in Holmes County. The
5 application must be submitted by December 31, 2001, and must
6 comply with the requirements of s. 290.0055. Notwithstanding
7 the provisions of s. 290.0065 limiting the total number of
8 enterprise zones designated and the number of enterprise zones
9 within a population category, the Office of Tourism, Trade,
10 and Economic Development may designate one enterprise zone
11 under this section. The Office of Tourism, Trade, and Economic
12 Development shall establish the initial effective date of the
13 enterprise zone designated pursuant to this section.
14 Section 3. Section 290.00697, Florida Statutes, is
15 created to read:
16 290.00697 Enterprise zone designation for Calhoun
17 County.--Calhoun County may apply to the Office of Tourism,
18 Trade, and Economic Development for designation of one
19 enterprise zone within an area in Calhoun County. The
20 application must be submitted by December 31, 2001, and must
21 comply with the requirements of s. 290.0055, except subsection
22 (3) thereof. Notwithstanding the provisions of s. 290.0065
23 limiting the total number of enterprise zones designated and
24 the number of enterprise zones within a population category,
25 the Office of Tourism, Trade, and Economic Development may
26 designate one enterprise zone under this section. The Office
27 of Tourism, Trade, and Economic Development shall establish
28 the initial effective date of the enterprise zone designated
29 pursuant to this section.
30 Section 4. Section 290.00698, Florida Statutes, is
31 created to read:

1 290.00698 Enterprise zone designation for Okaloosa
2 County.--Okaloosa County may apply to the Office of Tourism,
3 Trade, and Economic Development for designation of one
4 enterprise zone within an area in Okaloosa County, which zone
5 encompasses an area up to 6 square miles. The application
6 must be submitted by December 31, 2001, and must comply with
7 the requirements of s. 290.0055, except subsection (3)
8 thereof. Notwithstanding the provisions of s. 290.0065
9 limiting the total number of enterprise zones designated and
10 the number of enterprise zones within a population category,
11 the Office of Tourism, Trade, and Economic Development may
12 designate one enterprise zone under this section. The Office
13 of Tourism, Trade, and Economic Development shall establish
14 the initial effective date of the enterprise zone designated
15 pursuant to this section.
16 Section 5. Section 290.00694, Florida Statutes, is
17 created to read:
18 290.00694 Enterprise zone designation for Sarasota
19 County or Sarasota County and Sarasota.--Sarasota County, or
20 Sarasota County and the City of Sarasota jointly, may apply to
21 the Office of Tourism, Trade, and Economic Development for
22 designation of one enterprise zone within the county, or
23 within both the county and the municipality, which zone
24 encompasses an area that is south of the north county line,
25 west of Tuttle Avenue, north of 10th Street, and east of U.S.
26 Highway 41. The application must be submitted by December 31,
27 2001, and must comply with the requirements of s. 290.0055.
28 Notwithstanding the provisions of s. 290.0065 limiting the
29 total number of enterprise zones designated and the number of
30 enterprise zones within a population category, the Office of
31 Tourism, Trade, and Economic Development may designate one

1 enterprise zone under this section. The Office of Tourism,
2 Trade, and Economic Development shall establish the initial
3 effective date of the enterprise zone designated under this
4 section.
5 Section 6. Enterprise zone designation for
6 Hillsborough County.--Hillsborough County may apply to the
7 Office of Tourism, Trade, and Economic Development for
8 designation of one enterprise zone within the county, which
9 zone encompasses a high-crime, low-income, high-unemployment
10 area that is north of Fowler Avenue, south of Bearss Avenue,
11 east of Florida Avenue, west of Bruce B. Downs Boulevard, near
12 the University of South Florida, adjacent to University Square
13 Mall, north of a major theme park, an area that has been
14 designated a federal Weed & Seed target area, and a Community
15 Development Block Grant (CDBG) target area and that houses an
16 active public/private 501(c)(3) community development
17 corporation working to improve the area. The application must
18 be submitted by December 31, 2002, and must comply with the
19 requirements of section 290.0055, Florida Statutes.
20 Notwithstanding the provisions of section 290.0065, Florida
21 Statutes, limiting the total number of enterprise zones
22 designated and the number of enterprise zones within a
23 population category, the Office of Tourism, Trade, and
24 Economic Development may designate one enterprise zone under
25 this section. The Office of Tourism, Trade, and Economic
26 Development shall establish the initial effective date of the
27 enterprise zone designated under this section.
28 Section 7. Section 290.00555, Florida Statutes, is
29 amended to read:
30 290.00555 Satellite enterprise zones.--Before December
31 31, 1999, Any municipality an area of which has previously

1 received designation as an enterprise zone in the population
2 category described in s. 290.0065(3)(a)3. may create a
3 satellite enterprise zone not exceeding 1.5 square miles in
4 area outside of and, notwithstanding anything contained in s.
5 290.0055(4), or any other law, in addition to the previously
6 designated enterprise zone boundaries. The Office of Tourism,
7 Trade, and Economic Development shall amend the boundaries of
8 the areas previously designated by any such municipality as
9 enterprise zones upon receipt of a resolution adopted by the
10 municipality describing the satellite enterprise zone areas,
11 as long as the additional areas are consistent with the
12 categories, criteria, and limitations imposed by s. 290.0055.
13 However, the requirements imposed by s. 290.0055(4)(d) do not
14 apply to such satellite enterprise zone areas.
15 Section 8. Satellite enterprise zones may be created
16 pursuant to s. 290.00555, Florida Statutes, effective
17 retroactively to December 31, 1999. Resolutions adopted to
18 create satellite enterprise zones under this section must be
19 submitted to the Office of Tourism, Trade, and Economic
20 Development no later than August 1, 2001. The Office of
21 Tourism, Trade, and Economic Development must amend the
22 boundaries of previously designated enterprise zones to create
23 eligible satellite enterprise zones no later than September 1,
24 2001. Notwithstanding the time limitations contained in
25 chapter 212, Florida Statutes, a business in a satellite
26 enterprise zone designated under this section which was
27 eligible to receive tax incentives pursuant to ss.
28 212.08(5)(g) and (h) and 212.096, Florida Statutes, during the
29 period beginning December 31, 1999, and ending on the date of
30 the creation of the satellite enterprise zone must submit an
31 application for the tax incentives by December 1, 2001. All

1 other requirements of the enterprise zone program apply to
2 such a business.
3 Section 9. Notwithstanding any provisions of law to
4 the contrary, the governing body of an inland county with a
5 state-designated enterprise zone and a population greater than
6 500,000 may apply to the Office of Tourism, Trade, and
7 Economic Development to amend the boundaries of one
8 noncontiguous area of an enterprise zone. The office shall
9 approve the application as long as the amended area does not
10 exceed 4 square miles and is consistent with the categories,
11 criteria, and limitations imposed by section 290.0055, Florida
12 Statutes, upon the establishment of such enterprise zone. The
13 enterprise zone boundary-amendment application must be
14 received before December 31, 2001.
15 Section 10. This act shall take effect upon becoming a
16 law.
