17 Section 23. Subsection (1) of section 163.356, Florida
18 Statutes, is amended to read:
19 163.356 Creation of community redevelopment agency.--
20 (1) Upon a finding of necessity as set forth in s.
21 163.355, and upon a further finding that there is a need for a
22 community redevelopment agency to function in the county or
23 municipality to carry out the community redevelopment purposes
24 of this part, any county or municipality may create a public
25 body corporate and politic to be known as a "community
26 redevelopment agency." A county or municipality having a
27 population equal to or greater than 50,000 may create, by a
28 vote of at least a majority plus one of the entire governing
29 body of the county or municipality, more than one community
30 redevelopment agency. Each such agency shall be constituted
31 as a public instrumentality, and the exercise by a community

1 redevelopment agency of the powers conferred by this part
2 shall be deemed and held to be the performance of an essential
3 public function. The Community redevelopment agencies agency
4 of a county have has the power to function within the
5 corporate limits of a municipality only as, if, and when the
6 governing body of the municipality has by resolution concurred
7 in the community redevelopment plan or plans proposed by the
8 governing body of the county.
