  1                      A bill to be entitled

  2         An act relating to filings with the Department

  3         of State; amending s. 15.16, F.S.; authorizing

  4         the department to discount a filing fee in an

  5         amount equal to the convenience charge imposed

  6         for an electronic record filing by way of a

  7         contractor; amending s. 607.193, F.S.; waiving

  8         the charge for late filings of supplemental

  9         corporate fees when the business entity did not

10         receive the uniform business report prescribed

11         by the department; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Subsection (6) of section 15.16, Florida

16  Statutes, is amended to read:

17         15.16  Reproduction of records; admissibility in

18  evidence; electronic receipt and transmission of records;

19  certification; acknowledgment.--

20         (6)  The Department of State may use government or

21  private sector contractors in the promotion or provision of

22  any electronic filing services and may discount the filing fee

23  in an amount equal to the convenience charge for such

24  electronic filings.

25         Section 2.  Paragraph (b) of subsection (2) of section

26  607.193, Florida Statutes, is amended to read:

27         607.193  Supplemental corporate fee.--

28         (2)

29         (b)  In addition to the fees levied under ss. 607.0122,

30  608.452, and 620.182 and the supplemental corporate fee, a

31  late charge of $400 shall be imposed if the supplemental

  1  corporate fee is remitted after May 1 unless the business

  2  entity did not receive the uniform business report prescribed

  3  by the department.

  4         Section 3.  This act shall take effect July 1, 2001.

  7                          SENATE SUMMARY

  8    Authorizes the Department of State to discount the filing
      fee, when a record is electronically filed through a
  9    contractor that imposes a convenience charge for that
      service, in an amount equal to the convenience charge.
10    Waives the charge for late submission of a supplemental
      corporate fee when the business entity did not receive
11    the uniform business report prescribed by the department.
