17 Section 3. (1) The serious and often adverse
18 consequences resulting from the sole reliance on the Florida
19 Comprehensive Assessment Test (FCAT) have increasingly
20 resulted in questions and significant concerns by students,
21 parents, teachers, and school administrators about how to
22 ensure that the test is used appropriately and in a manner
23 that is fair. Currently, there is no peer-reviewed,
24 research-based determination that the FCAT is a reliable and
25 valid instrument suitable to fairly assess students, schools,
26 and teachers. Therefore, the Office of Program Policy
27 Analysis and Government Accountability (OPPAGA), in
28 consultation with the Department of Education, shall conduct a
29 nationwide search for suitable independent research
30 organizations to submit proposals for review of the FCAT.
31 Based on the proposals and additional background information,

1 OPPAGA shall recommend an organization or organizations to the
2 Speaker of the House of Representatives, the President of the
3 Senate, and the majority and minority leaders of each house of
4 the Legislature. If no objections are made to the
5 recommendation within 14 calendar days, OPPAGA shall proceed
6 to contract with the recommended organization or organizations
7 for the FCAT review.
8 (2) The FCAT review shall be guided by the principles
9 and findings reported by the National Academy of Sciences on
10 high stakes testing in 1999. The review shall include, but is
11 not limited to, whether the FCAT is aligned adequately with
12 the Sunshine State Standards; whether the test accurately and
13 fairly measures what students have learned independent of
14 their socioeconomic background and readiness for the subject
15 matter being studied; whether the test can accurately reflect
16 annual student learning gains within a school; and whether the
17 test can accurately evaluate teacher performance.
18 (3) The Office of Program Policy Analysis and
19 Government Accountability shall provide the Speaker of the
20 House of Representatives, the President of the Senate, and the
21 majority and minority leaders of each house of the Legislature
22 with quarterly updates and a final report before March 1,
23 2002.
24 (4) The independent review of the FCAT shall be funded
25 by the Office of Program Analysis and Government
26 Accountability within its appropriated funds for fiscal year
27 2001-2002.
