13 Amendment (with title amendment)
14 On page 7, between lines 5 and 6 of the bill
15
16 insert:
17 Section 7. Subsection (1) of section 482.242, Florida
18 Statutes, is amended to read:
19 482.242 Preemption.--
20 (1) This chapter is intended as comprehensive and
21 exclusive regulation of pest control in this state. The
22 provisions of this chapter preempt to the state all regulation
23 of the activities and operations of pest control services,
24 including the pesticides used pursuant to labeling and
25 registration approved under chapter 487. No local government
26 or political subdivision of the state may enact or enforce an
27 ordinance that regulates pest control, except that the
28 preemption in this section does not prohibit a local
29 government or political subdivision from enacting an ordinance
30 regarding any of the following:
31 (a) Local occupational licenses adopted pursuant to

1 chapter 205.
2 (b) Land development regulations adopted pursuant to
3 chapter 163 which include regulation of any aspect of
4 development, including a subdivision, building construction,
5 sign regulation or any other regulation concerning the
6 development of land, or landscaping or tree protection
7 ordinances which do not include pesticide application
8 restrictions.
9 (c) Regulations that:
10 1. Require, for multi-complex dwellings in excess of
11 10 units, annual termite inspections for termite activity or
12 damage, including Formosan termites, which must be performed
13 by a person licensed under this chapter.
14 2. Require pest control treatments of structures that
15 have termite activity or damage which must be performed by a
16 person licensed under this chapter.
17 3. Require property owners or other persons to obtain
18 inspections or pest control treatments performed by a person
19 licensed under this chapter.

21 An ordinance by a local government or political subdivision
22 which requires an annual inspection or pest control treatment
23 must conform to current law.
24 (d)(c) Protection of wellhead protection areas and
25 high recharge areas.
26 (e)(d) Hazardous materials reporting as set forth in
27 part II of chapter 252, storage, and containment including as
28 relating to stormwater management.
29 (f)(e) Hazardous material unlawful discharge and
30 disposal.
31 (g)(f) Hazardous materials remediation.
