2 An act relating to police reports; amending s.
3 119.105, F.S.; requiring persons who request
4 access to police reports to sign an affidavit
5 as a condition of obtaining access to such
6 reports; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 119.105, Florida Statutes, is
11 amended to read:
12 119.105 Protection of victims of crimes or
13 accidents.--
14 (1) Police reports are public records except as
15 otherwise made exempt or confidential by general or special
16 law. Every person is allowed to examine nonexempt or
17 nonconfidential police reports. No person who inspects or
18 copies police reports for the purpose of obtaining the names
19 and addresses of the victims of crimes or accidents shall use
20 any information contained therein for any commercial
21 solicitation of the victims or relatives of the victims of the
22 reported crimes or accidents. Nothing herein shall prohibit
23 the publication of such information by any news media or the
24 use of such information for any other data collection or
25 analysis purposes.
26 (2) Every person who requests to inspect or copy a
27 police report must sign an affidavit as a condition of
28 obtaining access to such report.
29 Section 2. This act shall take effect July 1, 2001.
