1 A bill to be entitled
2 An act relating to total and permanently
3 disabled persons; amending ss. 196.012 and
4 196.101, F.S.; reducing the number of
5 physicians necessary to certify a total and
6 permanent disability for homestead exemption
7 purposes; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (11) of section 196.012, Florida
12 Statutes, is amended to read:
13 196.012 Definitions.--For the purpose of this chapter,
14 the following terms are defined as follows, except where the
15 context clearly indicates otherwise:
16 (11) "Totally and permanently disabled person" means a
17 person who is currently certified by a two licensed physician
18 physicians of this state who are professionally unrelated, by
19 the United States Department of Veterans Affairs or its
20 predecessor, or by the Social Security Administration, to be
21 totally and permanently disabled.
22 Section 2. Subsection (3) of section 196.101, Florida
23 Statutes, is amended to read:
24 196.101 Exemption for totally and permanently disabled
25 persons.--
26 (3) The production by any totally and permanently
27 disabled person entitled to the exemption in subsection (1) or
28 subsection (2) of a certificate of such disability from a two
29 licensed doctor doctors of this state or from the United
30 States Department of Veterans Affairs or its predecessor to
31 the property appraiser of the county wherein the property

1 lies, is prima facie evidence of the fact that he or she is
2 entitled to such exemption.
3 Section 3. This act shall take effect upon becoming a
4 law.
