1 A bill to be entitled
2 An act relating to citrus canker compensation;
3 providing appropriations; directing the
4 department to compensate certain owners of
5 citrus trees removed as part of eradication
6 programs; providing retroactive applicability;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. (1) The sum of $40 million is appropriated
12 from the General Revenue Fund to the Department of Agriculture
13 and Consumer Services, and the sum of $10 million is
14 appropriated from the Florida Citrus Advertising Trust Fund to
15 the Department of Agriculture and Consumer Services.
16 Notwithstanding any other law, these moneys shall be used by
17 the department to compensate, in the amount of $100 a tree,
18 the owners of citrus trees removed as part of a citrus canker
19 eradication program. Compensation may be paid under this
20 section only for the removal of trees located on residential
21 property.
22 (2) The specification of a per-tree amount of
23 compensation in this section does not limit the amount of
24 compensation that may be paid by another entity or pursuant to
25 court order for the removal of citrus trees as part of a
26 citrus canker eradication program.
27 Section 2. This act shall take effect upon becoming a
28 law and shall operate retroactively to provide compensation
29 for citrus trees removed on or after January 1, 1995.

to $10 million

--Makes technical corrections.

--Deletes an amendment to s.581.184, F.S., that clarifies that
11 compensation for trees removed from nonresidential property
within the buffer zone is subject to annual legislative
12 appropriation.
13 --Changes the retroactive date for providing compensation from
January 1, 2000 to January 1, 1995.
