  2         An act relating to energy management; amending

  3         s. 255.257, F.S.; removing provisions which

  4         direct the Department of Management Services to

  5         provide for an energy management plan for state

  6         agencies, and which require state agencies to

  7         submit certain energy data to the department;

  8         providing that the department may develop such

  9         a plan; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Section 255.257, Florida Statutes, is

14  amended to read:

15         255.257  Energy management plan; buildings occupied by

16  state agencies.--

17         (1)  DEPARTMENT RESPONSIBILITY.--The Department of

18  Management Services shall constitute the responsible state

19  agency for developing and implementing an energy management

20  plan for state agencies occupying state-owned or state-leased

21  buildings. The Department of Community Affairs shall assist in

22  the development of this plan.

23         (1)(2)  ENERGY CONSUMPTION AND COST DATA.--Each state

24  agency shall collect submit, in the form and manner to be

25  prescribed by the Department of Management Services, data on

26  energy consumption and cost.  The data gathered shall be on

27  state-owned facilities and metered state-leased facilities of

28  5,000 net square feet or more.  These data will be used in the

29  computation of the effectiveness of the state energy

30  management plan and the effectiveness of the energy management

31  program of each of the reporting agencies.  The department

  1  shall advise the various agencies on the effectiveness of

  2  their energy management programs.

  3         (2)(3)  ENERGY MANAGEMENT COORDINATORS.--Each state

  4  agency, the Florida Public Service Commission, the Department

  5  of Military Affairs, and the judicial branch shall appoint a

  6  coordinator whose responsibility shall be to advise the head

  7  of the agency on matters relating to energy consumption in

  8  facilities under the control of that head or in space occupied

  9  by the various units comprising that agency, in vehicles

10  operated by that agency, and in other energy-consuming

11  activities of the agency.  The coordinator shall cooperate

12  with the Department of Management Services in the

13  implementation of the state energy management plan.  The

14  coordinator shall implement the energy management program

15  jointly agreed upon by the agency concerned and the

16  department.

17         (3)(4)  CONTENTS OF THE STATE ENERGY MANAGEMENT

18  PLAN.--The Department of Management Services may shall develop

19  a state energy management plan consisting of, but not limited

20  to, the following elements:

21         (a)  Data-gathering requirements;

22         (b)  Building energy audit procedures;

23         (c)  Uniform data analysis procedures;

24         (d)  Employee energy education program measures;

25         (e)  Energy consumption reduction techniques;

26         (f)  Training program for agency energy management

27  coordinators; and

28         (g)  Guidelines for building managers.

30  The plan shall include a description of actions to reduce

31  consumption of electricity and nonrenewable energy sources

  1  used for space heating and cooling, ventilation, lighting,

  2  water heating, and transportation.

  3         (5)  INFORMATION TRANSFER.--The state energy management

  4  plan, with results, shall be made available to aid in

  5  improving local government energy management programs.

  6         Section 2.  This act shall take effect upon becoming a

  7  law.
