1 A bill to be entitled
2 An act relating to the Department of
3 Corrections; amending s. 944.31, F.S.;
4 authorizing the secretary of the department to
5 designate as law enforcement officers employees
6 of the department's inspector general's office
7 who are certified as law enforcement officers;
8 prescribing the powers and duties of employees
9 so designated; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 944.31, Florida Statutes, is
14 amended to read:
15 944.31 Inspector general; inspectors; power and
16 duties.--The inspector general shall be responsible for prison
17 inspection and investigation, internal affairs investigations,
18 and management reviews. The office of the inspector general
19 shall be charged with the duty of inspecting the penal and
20 correctional systems of the state. The office of the inspector
21 general shall inspect each correctional institution or any
22 place in which state prisoners are housed, worked, or kept
23 within the state, with reference to its physical conditions,
24 cleanliness, sanitation, safety, and comfort; the quality and
25 supply of all bedding; the quality, quantity, and diversity of
26 food served and the manner in which it is served; the number
27 and condition of the prisoners confined therein; and the
28 general conditions of each institution. The office of
29 inspector general shall see that all the rules and regulations
30 issued by the department are strictly observed and followed by
31 all persons connected with the correctional systems of the

1 state. The office of the inspector general shall coordinate
2 and supervise the work of inspectors throughout the state. The
3 inspector general and inspectors may enter any place where
4 prisoners in this state are kept and shall be immediately
5 admitted to such place as they desire and may consult and
6 confer with any prisoner privately and without molestation.
7 The inspector general and inspectors shall be responsible for
8 criminal and administrative investigation of matters relating
9 to the Department of Corrections. The secretary may designate
10 persons holding law enforcement certification within the
11 office of the inspector general as law enforcement officers,
12 as necessary, to enforce any criminal law and conduct any
13 criminal investigation on property owned or leased by the
14 department or involving matters over which the department has
15 jurisdiction. Persons designated as law enforcement officers
16 must be certified under s. 943.1395. During In such
17 investigations, the inspector general and inspectors may
18 consult and confer with any prisoner or staff member privately
19 and without molestation and shall have the authority to arrest
20 detain any person for violations of the criminal laws of the
21 state. Such detention shall be made only on properties owned
22 or leased by the department, and The arrested detained person
23 shall be surrendered without delay to the sheriff of the
24 county in which the arrest detention is made, with a formal
25 complaint subsequently made against her or him in accordance
26 with law.
27 Section 2. This act shall take effect upon becoming a
28 law.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
2 Senate Bills 1708 and 1626

4 The Committee Substitute adopts the entire statutory language
from SB 1708, limits the scope of the prison inspector/law
5 enforcement officers to the jurisdiction of the Department of
Corrections, and changes the effective date.
